The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Environment Protection (Pulp Mills) Amendment Act 2008.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Environment Protection Act 1993

3—Amendment of section 7—Interaction with other Acts

(1) Section 7—after subsection (3) insert:

(3a) Despite subsection (3), this Act applies to pollution caused by an activity authorised by—

(a) the Pulp and Paper Mills Agreement Act 1958 or the agreement set out in the schedule to that Act; and

(b) the Pulp and Paper Mill (Hundreds of Mayurra and Hindmarsh) Act 1964 or the Indenture (within the meaning of that Act),

and, if the provisions of this Act are inconsistent with any provision of those Acts or an agreement or Indenture to which those Acts relate, this Act prevails to the extent of the inconsistency.
