The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Primary Produce (Food Safety Schemes) (Miscellaneous) Amendment Act 2005.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.


Part 2—Amendment of Primary Produce (Food Safety Schemes) Act 2004

3—Amendment of section 17—Periodic fees and returns

(1) Section 17(1)—delete subsection (1) and substitute:

(1) For each period fixed by regulation, an accredited producer must, not later than the date fixed by regulation—

(a) pay to the accreditation body the fee fixed by regulation; and

(b) lodge with the accreditation body a return that conforms to the requirements of the body about its form, contents and the manner in which it is made.

(2) Section 17(2)—delete "the annual" wherever it occurs and substitute, in each case:

Section 46(3)—after paragraph (d) insert:

(e) contain provisions of a savings or transitional nature.

5—Amendment of Schedule 1—Related amendments, repeals and transitional provisions

Clause 4(3)—delete subclause (3)
