The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Summary Offences (Schoolies Events) Amendment Act 2007.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Summary Offences Act 1953

3—Insertion of section 19

After section 18A insert:

19—Declared events celebrating the end of school

(1) The Minister may, by notice in the Gazette, declare an event that is to be held to celebrate the end of school to be an event to which this section applies.

(2) A notice under subsection (1) must specify the date on which, and times during which, the event will be held.

(3) A person must not hold an event to which this section applies in an area that is not an enclosed area.

Maximum penalty: $10 000.

(4) Subject to subsection (5), a person must not be allowed admittance to an event to which this section applies unless the person produces evidence of identity that—

(a) includes a photograph of the person; and

(b) indicates that the person has been enrolled at a school during the year in which the event is held.

Maximum penalty: $5 000.

(5) Subsection (4) does not apply to a person who—

(a) is employed or engaged to provide services or facilities or to undertake duties at the event; or

(b) is required, in the course of his or her employment or engagement, to provide services or facilities or to undertake duties at the event,

(whether the person is paid or is acting as a volunteer).

(6) An area is enclosed for the purposes of this section if entry to the area can only be gained through doors, gates or other access points at which admittance to the area can be controlled.
