The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Work Health and Safety (Representative Assistance) Amendment Act 2017.

2—Commencement

This Act will come into operation 3 months after the day on which it is assented to by the Governor.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Work Health and Safety Act 2012

4—Amendment of section 68—Powers and functions of health and safety representatives

(1) Section 68(4)—delete subsection (4) and substitute:

(4) If a person assisting a health and safety representative under subsection (2)(g) requires access to the workplace to provide the assistance, the health and safety representative must give notice of the assistant's proposed entry to—

(a) the person conducting the business or undertaking for whom the representative's workgroup carries out the work at the workplace; and

(b) the person with management or control of the workplace.

(4a) A notice under subsection (4)


must—

(a) comply with the regulations; and

(b) be given during the usual working hours at the workplace at least 24 hours, but not more than 14 days, before the assistant's entry.

(2) Section 68(6)—delete subsection (6)
