FACT SHEET Pharmacy Control Amendment Bill 2016 The Pharmacists Registration Act 2001 was amended in 2010 to become the Pharmacy Control Act 2001 as the primary legislative instrument to regulate Tasmania’s pharmacy business sector. Since its enactment it has been identified that a number of housekeeping amendments to the Act are necessary in order to fine-tune the regulatory framework. The amendments arise from a request from the Tasmanian Pharmacy Authority, as the regulator, to review and clarify or improve the operation of the legislation to fulfil the intent of the Act. These amendments clarify and support existing policy, supporting the objectives of the Principal Act. The Bill: corrects errors and clarifies arrangements to assist the Tasmanian Pharmacy Authority to more effectively provide regulatory oversight to pharmacy businesses inserts new terms and improves existing definitions to clarify the intent of the Act replaces the phrase “responsible occupier” with the word “owner” throughout the Act clarifies the responsibilities of owners of a pharmacy business to appropriately reflect their obligations expands the approved ownership structures in which a pharmacy business may be operated requires alterations to a pharmacy business, either in the structure of the business or alterations to the premises, to be approved by the Tasmanian Pharmacy Authority introduces a new offence provision for owners who do not provide requested information to the Tasmanian Pharmacy Authority Page 1 of 1
