FACT SHEET Restraint Orders Bill 2019 The Restraint Orders Bill 2019 replaces and updates Part XA of the Justices Act 1959 as part of broader reforms associated with the introduction of the Magistrates Court (Criminal and General Division) Bill 2019. The Restraint Orders Bill 2019 retains the principles embodied in existing restraint order legislation, while updating definitions and improving the operation and availability of orders made under those provisions. The Bill includes provisions relating to: restraint orders; interim restraint orders; and electronic interim restraint orders. The Bill also makes provision for the registration of external restraint orders, which encompasses certain orders made by courts of another State, Territory, or New Zealand. The provisions relating to restraint orders, interim restraint orders, electronic interim restraint orders and external restraint order provisions in this Bill largely replicate the current provisions of the Justices Act 1959.
