CONSUMER CREDIT (TASMANIA) (TRANSITIONAL) REGULATIONS 2006 (S.R. 2006, NO. 127) - REG 4

Application of certain provisions of Part 11 of Consumer Credit (Tasmania) Regulations

(1)  For the purposes of the application of Part 11 of the Consumer Credit (Tasmania) Regulations to a particular credit provider –
(a) where a provision of that Part contains a reference to the commencement of the Code and there was in force on 28 February 1997 an order under section 5 or 6 of the Act in respect of that credit provider, that reference is taken to be a reference to the day on which that order took effect; or
(b) where a provision of that Part contains a reference to the commencement of the Code and there was no such order in force on that day, that reference is taken to be a reference to 1 March 1997.
(2)  This regulation does not derogate from the application of the Code or the Consumer Credit (Tasmania) Regulations as a law of Tasmania.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) provide that, for the purposes of the application of Part 11 of the Consumer Credit (Tasmania) Regulations to a particular credit provider, a reference to the commencement of the Consumer Credit (Tasmania) Code in that Part is a reference to the day on which a certain order under section 5 or 6 of the Consumer Credit (Tasmania) Act 1996 took effect or to 1 March 1997; and
(b) are made consequentially on the repeal of the Consumer Credit (Tasmania) (Transitional) Regulations 1997 under section 11 of the Subordinate Legislation Act 1992 .
