Regulation 37C(2) of the Principal Regulations is amended by inserting after paragraph (d) the following paragraph:

(da) the determination is to allow for any costs associated with the preparation for participation in, and the participation in, the National Electricity Market attributable to providing services to the notional tariff base, as calculated in accordance with a methodology approved by the Regulator;

These regulations amend the Electricity Supply Industry (Price Control) Regulations 2003 by requiring that the Regulator take into account National Electricity Market participation costs in making an electricity retail price determination for 2007.
