FISHERIES (MACKEREL) RULES 2019 (S.R. 2019, NO. 5) - REG 22

Procedures for dealing with certain threatened, endangered and protected species

(1)  In this rule –
threatened, endangered and protected species means species listed in Chapter 5 of the Environment Protection and Biodiversity Conservation Act 1999 of the Commonwealth including dolphins, seals and seabirds.
(2)  Before acting under the authority of a mackerel fishing licence, the holder of the licence must have an approved written procedure in respect of the measures to be taken to mitigate interactions between the licensee’s fishing vessel and threatened, endangered and protected species.
Penalty:  Grade 3 penalty.
(3)  The holder of a mackerel fishing licence must comply with the approved written procedure when taking mackerel under the authority of the licence.
Penalty:  Grade 3 penalty.
