MINES WORK HEALTH AND SAFETY (SUPPLEMENTARY REQUIREMENTS) REGULATIONS 2022 (S.R. 2022, NO. 117) - REG 17

Health monitoring programs
(1)  A mine operator must, as part of the health and safety management system for the mine, develop and implement a documented health monitoring program in relation to the health, safety and welfare of all persons performing work at the mine.
Penalty:  In the case of –
(a) a body corporate, a fine not exceeding $13 000; and
(b) an individual, a fine not exceeding $6 500.
(2)  For the purposes of subregulation (1) , a health monitoring program is a program that –
(a) is commensurate with the likely exposures and risks to health and safety at the mine; and
(b) satisfies the requirements of the Work Health and Safety Regulations 2022 in relation to programs in respect of health monitoring; and
(c) takes into account any relevant guidance material.
