PARLIAMENT OF VICTORIA Introduced in the Council Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 A Bill for an Act to amend the Education and Training Reform Act 2006 and various University Acts and for other purposes. The Parliament of Victoria enacts: PART 1--PRELIMINARY 1 Purposes The main purposes of this Act are-- (a) to amend the Education and Training 5 Reform Act 2006-- (i) to transfer certain functions of the Victorian Skills Commission to the Victorian Registration and Qualifications Authority or the 10 Minister; and 571194B.I-1/5/2012 1 BILL LC INTRODUCTION 1/5/2012
Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 1--Preliminary s. 2 (ii) to make the governance provisions relating to adult education institutions consistent with those of TAFE institutes; and 5 (iii) to give the County Court and the Magistrates' Court power to grant injunctions in respect of registered training organisations; and (iv) to enable the Victorian Registration and 10 Qualifications Authority to disclose information or give documents to certain Commonwealth authorities or bodies; and (v) to make other miscellaneous 15 amendments to that Act; and (b) to amend various University Acts to provide that Councils of Universities may grant leave to members of those Councils. 2 Commencement 20 (1) This Part and Part 7 come into operation on the day on which this Act receives the Royal Assent. (2) Section 62(5) is taken to have come into operation on 1 July 2007. (3) Subject to subsection (4), the remaining 25 provisions of this Act come into operation on a day or days to be proclaimed. (2) In section 3.3.30(1)(c) and (1)(g) of the Education and Training Reform Act 2006, for ", further" (wherever occurring) substitute 15 "and further". 33 Governing board membership For section 3.3.33(1)(a) of the Education and Training Reform Act 2006 substitute-- "(a) one member who is to be the chairperson of 20 the governing board must be appointed by the Governor in Council; (ab) a number of members must be appointed by the Minister that together with the chairperson is not less than half of the 25 members of the governing board;". 34 Removal from office of members For section 3.3.34(1) of the Education and Training Reform Act 2006 substitute-- "(1) The Governor in Council may remove the 30 chairperson from office at any time. Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 3--Amendments Concerning TAFE Institutes and Adult Education s. 35 Institutions 35 New sections 3.3.34A to 3.3.34D inserted After section 3.3.34 of the Education and Training Reform Act 2006 insert-- "3.3.34A Strategic plans 5 (1) The governing board of an adult education institution must, at the direction of the Minister and at the time or times determined by the Minister, prepare and submit to the Minister for acceptance a strategic plan for 10 the operation of the institution. (2) A strategic plan must be prepared in accordance with the guidelines established by the Minister from time to time. (3) The Minister may-- 15 (a) accept a strategic plan; or (b) accept a strategic plan with amendments; or (c) refuse to accept a strategic plan. (4) The governing board of an adult education 20 institution must advise the Minister if it wishes to exercise its functions in a manner inconsistent with its accepted strategic plan. 3.3.34B When statement of corporate intent to be prepared 25 (1) In respect of each year, the governing board of an adult education institution must-- (a) prepare, in consultation with the Secretary, a proposed statement of corporate intent in relation to the 30 provision of adult, community and further education, vocational education and training, employment and other associated programs and services; and 571194B.I-1/5/2012 10 BILL LC INTRODUCTION 1/5/2012
Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 3--Amendments Concerning TAFE Institutes and Adult Education s. 35 Institutions (b) submit the proposed statement of corporate intent to the Minister. (2) If, prior to 1 October, the Minister provides to the governing board of an adult education 5 institution a statement of expectations in relation to the operations of the institution in the next year, these must be taken into account in preparing a statement of corporate intent. 10 (3) If the governing board of an adult education institution and the Minister fail to agree on a statement of corporate intent before 1 March of the year to which the statement of corporate intent relates, the Minister may 15 make a statement of corporate intent in relation to the adult education institution. (4) A statement of corporate intent may be varied at any time if the governing board of an adult education institution and the 20 Minister so agree. (5) If the governing board of an adult education institution and the Minister fail to agree to a proposed variation of a statement of corporate intent within 28 days after the 25 variation is proposed, the Minister may-- (a) vary the statement of corporate intent; or (b) decline to vary the statement of corporate intent. 30 (6) The Minister must cause copies of each statement of corporate intent and any variation to be made available on request to a member of the public. 571194B.I-1/5/2012 11 BILL LC INTRODUCTION 1/5/2012
Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 3--Amendments Concerning TAFE Institutes and Adult Education s. 35 Institutions 3.3.34C Content of statement of corporate intent A statement of corporate intent made by the governing board of an adult education institution under section 3.3.34B must-- 5 (a) be consistent with the strategic plan accepted by the Minister for the institution; and (b) specify in respect of the year to which it relates-- 10 (i) the services to be provided by the institution and the funds to be provided to the institution; and (ii) the objectives, priorities and key performance outcomes to be met 15 by the institution; and (iii) the performance indicators, targets or other measures against which the performance of the institution is to be assessed and monitored; 20 and (iv) how and when the institution must report to the Minister and the Secretary on its performance in relation to the specified 25 objectives, priorities and key performance outcomes; and (v) any other matter agreed from time to time between the Minister and the governing board of the adult 30 education institution, or determined by the Minister. 571194B.I-1/5/2012 12 BILL LC INTRODUCTION 1/5/2012
Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 3--Amendments Concerning TAFE Institutes and Adult Education s. 35 Institutions 3.3.34D Annual meetings (1) The governing board of an adult education institution must ensure that the chief executive officer convenes an annual 5 meeting of the institution to be held on or after 1 January and-- (a) on or before 30 June in each year; or (b) if the Secretary in writing approves a later date, on or before that later date in 10 each year. (2) The chief executive officer of the institution must cause notice of the annual meeting to be published in a newspaper circulating generally in the area where the institution is 15 located giving notice-- (a) of the date, time and place of the meeting; and (b) that the meeting is open to the public. (3) The chief executive officer of the institution 20 must give notice of the annual meeting to the Secretary. (4) At each annual meeting of the governing board of an adult education institution the governing board of that institution-- 25 (a) must submit the financial statements and report of operations prepared in accordance with Part 7 of the Financial Management Act 1994; and (b) must report on the services provided by 30 the institution in the preceding year and on services proposed to be provided in the following year; and 571194B.I-1/5/2012 13 BILL LC INTRODUCTION 1/5/2012

Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 4--Power to Grant Injunctions in Respect of RTOs s. 36 PART 4--POWER TO GRANT INJUNCTIONS IN RESPECT OF RTOS 36 New Subdivision 4A inserted in Division 3 of Part 5.8 5 After Subdivision 4 in Division 3 of Part 5.8 of the Education and Training Reform Act 2006 insert-- "Subdivision 4A--Injunctions 5.8.3YA Injunctions to restrain conduct 10 (1) The Authority may apply to the County Court or the Magistrates' Court for the grant of an injunction restraining an RTO from engaging in conduct that constitutes-- (a) a contravention of a relevant law; or 15 (b) attempting or conspiring to contravene a relevant law; or (c) aiding, abetting, counselling or procuring another RTO to contravene a relevant law; or 20 (d) inducing or attempting to induce another RTO, whether by threats, promises or otherwise, to contravene a relevant law; or (e) being in any way directly or indirectly, 25 knowingly concerned in, or party to, the contravention by an RTO of a relevant law. (2) The Court may grant an injunction restraining an RTO from engaging in 30 conduct of the kind referred to in paragraphs (a) to (e) of subsection (1)-- 571194B.I-1/5/2012 15 BILL LC INTRODUCTION 1/5/2012
Education Legislation Amendment (VET Sector, Universities and Other Matters) Bill 2012 Part 4--Power to Grant Injunctions in Respect of RTOs s. 36 (a) if the Court is satisfied that the RTO is engaging in or has been engaging in conduct of that kind, whether or not it appears to the Court that the RTO 5 intends to engage again or continue to engage in the conduct; or (b) if it appears to the Court that, in the event that the injunction is not granted, it is likely that the RTO will engage in 10 conduct of that kind, whether or not the RTO has previously engaged in conduct of that kind and whether or not there is an imminent danger of substantial damage to any person if the 15 RTO engages in conduct of that kind; or (c) if the Court determines it to be appropriate, by consent of all the parties to the proceedings, whether or 20 not the RTO has engaged in, or is likely to engage in conduct of that kind. (3) An application for an injunction under this section may be made ex parte. 5.8.3YB Injunctions to do an act or thing 25 (1) The County Court or the Magistrates' Court, on the application of the Authority, may grant an injunction requiring an RTO to do any act or thing specified by the Court if the Court is satisfied that the RTO is engaging in 30 or has been engaging in conduct that constitutes-- (a) a contravention of a relevant law; or (b) attempting or conspiring to contravene a relevant law; or 571194B.I-1/5/2012 16 BILL LC INTRODUCTION 1/5/2012

(2) The power of the Court under this section to grant an injunction requiring an RTO to do an act or thing may be exercised-- 15 (a) whether or not it appears to the Court that the RTO intends to refuse or fail again, or to continue to refuse or fail, to do that act or thing; and (b) whether or not the RTO has previously 20 refused or failed to do that act or thing; and (c) whether or not there is an imminent danger of substantial damage to any person if the RTO refuses or fails to do 25 that act or thing.
