              EXPLANATORY MEMORANDUM


                              Clause Notes
Clause 1   provides that the purposes of the Bill are--
                   to amend the Parliamentary Committees Act 2003 to
                    abolish certain Joint House Committees; and
                   to amend the Parliamentary Salaries and
                    Superannuation Act 1968 in relation to additional
                    salaries and expense allowances to which certain
                    members of the Parliament are entitled; and
                   to make a statute law revision amendment to a provision
                    of the Integrity and Accountability Legislation
                    Amendment (Public Interest Disclosures, Oversight
                    and Independence) Act 2019 that amends the
                    Parliamentary Committees Act 2003.

Clause 2   provides for the commencement of the Bill.
           The Bill (other than clause 7) will come into operation on the
           day after the day on which the Bill receives the Royal Assent.
           Clause 7 of the Bill will come into operation on a day to
           be proclaimed with a default commencement date of
           1 January 2020.

Clause 3   repeals section 5(b), (d), (e) and (g) of the Parliamentary
           Committees Act 2003, which establishes the following Joint
           House Committees--
                   the Economic, Education, Jobs and Skills Committee;

 the Environment, Natural Resources and Regional Development Committee;  the Family and Community Development Committee;  the Law Reform, Road and Community Safety Committee. Clause 4 repeals sections 8, 10, 11 and 13 of the Parliamentary Committees Act 2003. These sections are no longer necessary as they set out the functions of Joint House Committees which are abolished by the Bill. Clause 5 repeals Parts 8 and 9 of the Parliamentary Committees Act 2003. These Parts are no longer necessary. They provide transitional provisions relating to previous legislative amendments to the Act. The provisions are spent. Clause 6 amends the Table in section 6 of the Parliamentary Salaries and Superannuation Act 1968 by inserting or substituting various items in the Table to provide, subject to that section, that--  the Parliamentary Secretary to the Premier is entitled to receive an additional salary and an expense allowance;  the additional salary to which the Government Whip in the Assembly is entitled is increased;  the Deputy Government Whip in the Assembly is entitled to receive an additional salary;  the additional salary and expense allowance of Parliamentary Secretaries, other than the Parliamentary Secretary to the Premier, remains the same;  the additional salary to which the Chairperson of the Scrutiny of Acts and Regulations Committee is entitled is increased; and  the chairperson of a standing committee appointed under standing orders of the Assembly or Council is entitled to receive an additional salary. Clause 7 is a statute law revision amendment. It substitutes an incorrect cross reference in section 91(1)(b) of the Integrity and Accountability Legislation Amendment (Public Interest 2

 


 

Disclosures, Oversight and Independence) Act 2019, which will consequentially amend the Parliamentary Committees Act 2003. Clause 8 provides that this Act is repealed on 1 July 2021. The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984). 3
