SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 135

    (1)     A person must not provide a social service, or engage another to provide a social service on its behalf, unless the person is registered under Part 3 to provide that social service.

Penalty:     240 penalty units, in the case of an individual;

    1200 penalty units, in the case of a body corporate.

Note

Section 297 provides that this section is a civil penalty provision. The penalty for contravention of this civil penalty provision is set out in the table in section 297.

    (2)     Subsection (1) does not apply to a person who is employed or engaged by a registered social service provider to provide a social service on behalf of the registered social service provider.

    (3)     A person who is not registered under Part 3 to provide a social service must not purport to be registered in respect of that service.

Penalty:     600 penalty units, in the case of an individual;

    3000 penalty units, in the case of a body corporate.
