SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 157

Compliance with and effect of undertaking

    (1)     While an enforceable undertaking is in force and being complied with—

        (a)     no proceeding may be brought for an offence against this Act or the regulations constituted by the contravention or alleged contravention to which the undertaking relates; and

        (b)     no other enforcement action available to the Regulator under this Act or the regulations may be taken in respect of any contravention or alleged contravention to which the undertaking relates.

    (2)     If a registered social service provider fulfils an enforceable undertaking in full, at the expiry of the undertaking, no proceeding may be brought for the offence against this Act or the regulations constituted by the contravention or alleged contravention to which that undertaking related.

    (3)     If a registered social service provider partially fulfils an enforceable undertaking, at the expiry of the undertaking, no proceeding may be brought for the offence against this Act or the regulations constituted by the contravention or alleged contravention to which that undertaking related so far as the undertaking has been partially fulfilled.
