SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 188

In this Act—

"protected information" means information (including "confidential information") that—

        (a)     is not in the public domain; and

        (b)     is obtained by or disclosed to the Regulator, an independent investigator, a member of a Panel, an authorised officer, or a member of staff of or person authorised or engaged by the Regulator; and

        (c)     is obtained or disclosed for the purpose of carrying out a function or duty of the Regulator, an independent investigator, a Panel or an authorised officer under this Act or any other Act; and

        (d)     is obtained or disclosed—

              (i)     in the course of exercising a power or carrying out a function or duty of the Regulator, an independent investigator, a member of a Panel or an authorised officer under this Act or any other Act; or

              (ii)     by another relevant agency under this Part; or

              (iii)     under Division 8 of Part 5 or Division 2 of Part 6.
