(1) A provider may give a resident a notice to vacate the supported residential service if—
(a) the resident is in need of more health care than can be arranged by the supported residential service; and
(b) the provider has complied with the provider's obligations under section 233(1); and
(c) the Secretary has completed the Secretary's enquiries and assessment under section 235.
(2) A notice to vacate under subsection (1) must specify a termination date that is not less than 14 days after the date on which the notice is given.
