(1) If a regulatory entity is investigating, or commences an investigation into the conduct of a WCES worker or carer—
(a) despite section 63, the Regulator may determine not to convene a Panel in relation to that conduct; and
(b) despite section 69(1), a Panel convened to hear a matter relating to that conduct may determine not to deal with the matter; and
(c) despite section 57, the Regulator may determine not to commence or proceed with an investigation of the conduct.
(2) In making a determination under subsection (1), the Regulator or Panel must have regard to the desirability of avoiding unnecessary duplication in the investigation of, and proceedings relating to, the conduct of a WCES worker or carer.
(3) The Regulator or Panel must not make a determination under subsection (1) if making the determination would prejudice the operation of the worker and carer exclusion scheme.
