SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 73

Review of interim exclusion

    (1)     If the Regulator or a Panel issues an interim exclusion, the Regulator or Panel (as the case may be) must review the decision to issue that exclusion—

        (a)     on the day specified in the notice of the interim exclusion for the purposes of section 71(3)(d); and

        (b)     at least once every 30 days after the review under paragraph (a).

    (2)     When reviewing a decision to issue an interim exclusion, the Regulator or Panel

        (a)     must consider any submission made under section 72 concerning the interim exclusion; and

        (b)     may consider any other information that the Regulator or Panel considers relevant.

    (3)     After reviewing a decision to issue an interim exclusion, the Regulator or Panel must—

        (a)     affirm the decision to issue the interim exclusion if—

              (i)     the Regulator or Panel reasonably believes that the WCES worker or carer poses an unjustifiable risk of harm to WCES users; and

              (ii)     the Regulator or Panel reasonably believes that the interim exclusion is necessary to protect WCES service users before the Panel determines the allegation; or

        (b)     revoke the interim exclusion.
