SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 74

Notice of review of interim exclusion

    (1)     After reviewing a decision to issue an interim exclusion under section 73, the Regulator or a Panel must, as soon as practicable, give notice of the review in writing to—

        (a)     the WCES worker or carer; and

        (b)     any WCES service provider who is engaging or employing the WCES worker or carer to provide a WCES service.

    (2)         The Regulator or Panel may give notice in writing of the review to any WCES service provider who has at any time engaged or employed the WCES worker or carer to provide a WCES service.

    (3)     A notice under subsection (1) must—

        (a)     state whether the interim exclusion is affirmed or revoked; and

        (b)     if the interim exclusion is affirmed—

              (i)             set out the reasons and information on which the Regulator or Panel made the decision to affirm the interim exclusion; and

              (ii)     specify the date on which the Regulator or Panel will next review the decision to issue the interim exclusion; and

              (iii)     state that the WCES worker or carer may at any time make submissions on the interim exclusion to the Regulator or Panel; and

        (c)     if the interim exclusion is revoked, specify the date on which the revocation comes into effect.
