SOCIAL SERVICES REGULATION ACT 2021 (NO. 37 OF 2021) - SECT 84

WCES service provider must ask for database check for proposed WCES workers or carers

    (1)     Before employing or engaging a person as a WCES worker or carer, a WCES service provider must request the Regulator to disclose whether—

        (a)     the person is the subject of any investigation under this Part that has not been finally determined; and

        (b)     an exclusion decision is in force in relation to a person; and

        (c)     if an exclusion decision is in force, the WCES services the person is excluded from providing.

    (2)     The Regulator may provide any information recorded on the WCES database to a WCES service provider for the purposes of responding to a request under subsection (1).
