After section 59 of the Water Act 1989 insert —
(1) The Minister, on the application of the holder of a licence issued under section 51, may amend the licence.
(2) The holder of a licence issued under section 51 may apply to the Minister for an amendment of the licence under this section.
(3) An application under this section—
(a) must be in a form and made in a manner approved by the Minister; and
(b) contain any information that is required by the Minister; and
(c) be accompanied by the fee fixed by the Minister for that class of application (if any).
The procedure that applies under this Division to an application for the issue of a licence under section 51 applies, with any necessary modifications and subject to section 59C, to an application under section 59A for the amendment of such a licence.
In considering an application under section 59A, the Minister—
(a) must have regard to any matter referred to in section 53(1)(a) to 53(1)(b); and
(b) must give effect to the matters referred to in section 53(2); and
(c) may have regard to any other matter that the Minister thinks fit.".
