                               A Bill for


An Act to amend the Constitution Act 1889.



The Parliament of Western Australia enacts as follows:

1    1.         Short title
2               This is the Constitution Amendment (Recognition of Aboriginal
3               People) Act 2014.

4    2.         Commencement
5               This Act comes into operation on the day on which it receives
6               the Royal Assent.

7    3.         Act amended
8               This Act amends the Constitution Act 1889.

9    4.         Preamble amended
10        (1)   In the Preamble delete "contained:" and insert:

12              contained;

14        (2)   At the end of the Preamble insert:

16              And whereas the Legislature of the Colony, as previously
17              constituted, was replaced through this Act with a Parliament,
18              to consist of the Queen, the Legislative Council and the
19              Legislative Assembly with the members of both Houses
20              chosen by the people, and, as constituted, continued as the
21              Parliament of the Colony until Western Australia's accession
22              as an Original State of the Commonwealth of Australia in
23              1901 and thereafter has been the Parliament of the State;
24              And whereas the Houses of the Parliament resolve to
25              acknowledge the Aboriginal peoples as the First Peoples of
26              Western Australia and traditional custodians of the land, the
27              said Parliament seeks to effect a reconciliation with the
28              Aboriginal peoples of Western Australia:

1   5.      Section 42 deleted
2           Delete section 42.
