Use of land or buildings subject to Heritage Agreement 2 page i 63 -- 1 Western Australia LEGISLATIVE ASSEMBLY (Introduced by Dr Woollard MLA) Heathcote Hospital Site (Reservation) Bill 2001 A Bill for An Act to dedicate the Heathcote Hospital site as a Class A reserve and for related purposes. The Parliament of Western Australia enacts as follows: 1. Short title This Act may be cited as the Heathcote Hospital Site (Reservation) Act 2001. 5 2. Commencement This Act comes into operation on the day on which it receives the Royal Assent. page 1 Heathcote Hospital Site (Reservation) Bill 2001 s. 3 3. Interpretation In this Act -- "land" means the land described in the Schedule and commonly known as the "Heathcote Hospital site"; 5 "Minister" has the meaning it is given under section 7 of the Land Administration Act 1997. 4. Land vested as a class A reserve Upon the commencement of this Act, the land is subject to Part 4 of the Land Administration Act 1997 and the Minister, 10 acting under that Part, is required to reserve the land to the Crown as a class A reserve for the purpose of providing public open space. 5. Use of land or buildings subject to Heritage Agreement (1) Use of the land must not contravene the provisions of any 15 Heritage Agreement that is the subject of a memorial entered on the title under Part 4 of the Heritage of Western Australia Act 1990. (2) In this section, "land" includes any building any work carried out on the land or to a building. 20 Schedule Description of Land [section 3] All the land comprising Swan Location 13937 shown on Land Administration diagram 80316 and entered on Certificate of Title volume 3120 / folio 941. 25
