Right of disposal of estate or interest in land to Crown 3 182 -- 1 page i Western Australia LEGISLATIVE ASSEMBLY (Introduced by Ms Walker, MLA) Heritage of Western Australia (Crown Acquisition of Registered Places) Amendment Bill 2006 A Bill for An Act to amend the Heritage of Western Australia Act 1990 to confer a right upon an owner of an estate or interest in a place entered in the Register of Heritage Places to dispose of the owner's interest in the place to the Crown at a price determined by reference to the pre-registration value of the owner's estate or interest in the place. The Parliament of Western Australia enacts as follows: page 1 Heritage of Western Australia (Crown Acquisition of Registered Places) Amendment Bill 2006 Part 1 Preliminary s. 1 Part 1 -- Preliminary 1. Short title This Act may be cited as the Heritage of Western Australia (Crown Acquisition of Registered Places) Amendment Act 2006. 5 2. Commencement This Act comes into operation on the day on which it receives the Royal Assent. page 2 Heritage of Western Australia (Crown Acquisition of Registered Places) Amendment Bill 2006 Amendments to the Heritage of Western Australia Act 1990 Part 2 s. 3 Part 2 -- Amendments to the Heritage of Western Australia Act 1990 3. The Act amended The amendments in this Part are to the Heritage of Western 5 Australia Act 1990*. [* Reprint 2 as at 9 June 2006 (see the Notes to the Heritage of Western Australia Act 1990)]. 4. Section 76A inserted After section 76 the following section is inserted -- 10 " 76A. Right of disposal of estate or interest in land to Crown (1) Upon an interim or permanent entry relating to a place being made in the Register, the owner of any estate or 15 interest in land which is or forms part of the registered place may give notice in writing to the Minister in the prescribed form that the owner wishes to dispose of the owner's estate or interest in land to the Crown in accordance with this section. 20 (2) Upon the Minister receiving a notice under subsection (1) the Minister on behalf of the Crown must as soon as practicable acquire the owner's estate or interest in the land. (3) Where an owner's estate or interest in land is to be 25 acquired by the Crown under this section -- (a) the provisions of section 73 relating to the compulsory acquisition of land apply as if an advertisement had been published by the Council with respect to the registered place 30 under section 73(1)(a); and page 3 Heritage of Western Australia (Crown Acquisition of Registered Places) Amendment Bill 2006 Part 2 Amendments to the Heritage of Western Australia Act 1990 s. 4 (b) the price at which the Crown acquires the owner's estate or interest in land must be a value determined as if the estate or interest in the land were not the subject of an interim or 5 permanent entry in the Register. ".
