Section 246U amended 3 067--1 page i Western Australia LEGISLATIVE ASSEMBLY (Introduced by Mr Redman MLA) Health (Fresh Produce - State or Territory of Origin) Amendment Bill 2005 A Bill for An Act to amend the Health Act 1911 to require labelling as to the State or Territory of origin of fresh produce displayed for retail sale. The Parliament of Western Australia enacts as follows: page 1 Health (Fresh Produce - State or Territory of Origin) Amendment Bill 2005 Part 1 Preliminary s. 1 Part 1 -- Preliminary 1. Short title This Act may be cited as the Health (Fresh Produce - State or Territory of Origin) Amendment Act 2005. 5 2. Commencement This Act comes into operation on the day on which it receives the Royal Assent. page 2 Health (Fresh Produce - State or Territory of Origin) Amendment Bill 2005 Amendment of Health Act 1911 Part 2 s. 3 Part 2 -- Amendment of Health Act 1911 3. The Act amended The amendments in this Part are to the Health Act 1911. 4. Section 246G amended 5 Section 246G is amended by inserting after the definition of "food vending machine" -- " "fresh produce" means -- (a) the edible, fleshy fructification of plants, 10 distinguished by their sweet, acid and ethereal flavours; (b) vegetables other than frozen, dehydrated or preserved vegetables; and (c) nuts, including peanuts and coconuts; 15 ". 5. Section 246U amended Section 246U(2) is amended by deleting "Food" in the first place in which it occurs and inserting instead -- " Subject to subsection (2a), food ". 20 6. Section 246U amended After subsection 246U(2) the following subsection is inserted -- " (2a) Where -- 25 (a) fresh produce is displayed for retail sale otherwise than in a package; and (b) that fresh produce originated from within the Commonwealth, page 3 Health (Fresh Produce - State or Territory of Origin) Amendment Bill 2005 Part 2 Amendment of Health Act 1911 s. 6 there must be displayed on or in connection with the display a label containing, in standard type of 9mm, a statement indicating the State or Territory of origin of the fresh produce. 5 ".
