Section 9 amended 2 271--1 page i Western Australia LEGISLATIVE ASSEMBLY Inheritance (Family and Dependants Provision) Amendment Bill 2012 A Bill for An Act to amend the Inheritance (Family and Dependants Provision) Amendment Act 2011. The Parliament of Western Australia enacts as follows: page 1 Inheritance (Family and Dependants Provision) Amendment Bill 2012 s. 1 1 1. Short title 2 This is the Inheritance (Family and Dependants Provision) 3 Amendment Act 2012. 4 2. Commencement 5 This Act comes into operation on the day on which it receives 6 the Royal Assent. 7 3. Act amended 8 This Act amends the Inheritance (Family and Dependants 9 Provision) Amendment Act 2011. 10 4. Section 5 replaced 11 Delete section 5 and insert: 12 13 5. Section 4 amended 14 In section 4(1) insert in alphabetical order: 15 16 stepchild means a person who was alive on the date on 17 which the deceased married or entered into a de facto 18 relationship with a parent of the person but who is not a 19 child of the deceased; 20 21 5. Section 9 amended 22 In section 9(1)(b) in the insertion delete paragraph (eb) and 23 insert: 24 25 (eb) a stepchild of the deceased, if -- 26 (i) the deceased received or was entitled to 27 receive property from the estate of a page 2 Inheritance (Family and Dependants Provision) Amendment Bill 2012 s. 5 1 parent of the stepchild, otherwise than 2 as a creditor of that estate; and 3 (ii) the value of that property, at the time of 4 the parent's death, is greater than the 5 prescribed amount; 6
