Section 15 amended 4 229--2 page i Western Australia LEGISLATIVE ASSEMBLY (As amended during consideration in detail) Lotteries Commission Amendment Bill 2011 A Bill for An Act to amend the Lotteries Commission Act 1990. The Parliament of Western Australia enacts as follows: page 1 Lotteries Commission Amendment Bill 2011 s. 1 1 1. Short title 2 This is the Lotteries Commission Amendment Act 2011. 3 2. Commencement 4 This Act comes into operation as follows -- 5 (a) sections 1 and 2 -- on the day on which this Act 6 receives the Royal Assent; 7 (b) the rest of the Act -- on the day after that day. 8 3. Act amended 9 This Act amends the Lotteries Commission Act 1990. 10 4. Section 6 amended 11 (1) In section 6(2) delete "functions." and insert: 12 13 functions, including the facilitation of syndicate entries 14 to any games of lotto. 15 16 (2) After section 6(2) insert: 17 18 (3A) For the purpose of facilitating syndicate entries to 19 games of lotto, the Commission may purchase entries 20 into games of lotto and make portions of those entries 21 available for sale as syndicate shares. 22 23 (3) In section 6(3): 24 (a) in paragraph (b) delete "subsection." and insert: 25 26 subsection; and 27 page 2 Lotteries Commission Amendment Bill 2011 s. 5 1 (b) after paragraph (b) insert: 2 3 (c) enter into a contract or arrangement with a 4 person or body (including a local government 5 or a department of the Public Service, or other 6 agency or instrumentality, of the State or the 7 Commonwealth) to provide consultancy or 8 advisory services to that person or body, 9 whether for a fee or not. 10 11 (4) After section 6(3) insert: 12 13 (4) A contract or arrangement under subsection (3)(c) can 14 only be made with the Treasurer's concurrence and is 15 void and unenforceable without it. 16 17 5. Section 7A inserted 18 After section 6 insert: 19 20 7A. Exemptions from s. 6(4) 21 (1) The Minister, with the Treasurer's concurrence, may 22 by order exempt a contract or arrangement, or class of 23 contracts or arrangements, from the operation of 24 section 6(4) either unconditionally or on specified 25 conditions. 26 (2) An order under subsection (1) is to show sufficient 27 particulars of the contract or arrangement, or class of 28 contracts or arrangements, to which it relates to enable 29 the contract or arrangement, or class, to be identified. 30 (3) The Minister must, within 6 sitting days after an order 31 under subsection (1) is made, cause it to be laid before 32 each House of Parliament. page 3 Lotteries Commission Amendment Bill 2011 s. 6 1 (4) Subject to subsection (5), an order made under 2 subsection (1) is not subsidiary legislation for the 3 purposes of the Interpretation Act 1984. 4 (5) The Interpretation Act 1984 sections 43 (other than 5 subsection (6)) and 44 and Part VIII apply to an order 6 made under subsection (1) as if it were subsidiary 7 legislation. 8 9 6. Section 15 amended 10 After section 15(3) insert: 11 12 (4) If, as a result of holding unsold syndicate shares at the 13 time of a lotto draw, the Commission is the holder of a 14 winning entry in that game of lotto, the prize allocated 15 to that winning entry is to be treated as if it were an 16 unclaimed prize under section 16, and the moneys 17 credited to the relevant Account without the 18 requirement to wait 12 months. 19
