WESTERN AUSTRALIA LEGISLATIVE COUNCIL (Introduced by Hon. Norm Kelly) METROPOLITAN REGION TOWN PLANNING SCHEME AMENDMENT BILL 1998 A BILL FOR AN ACT to amend the Metropolitan Region Town Planning Scheme Act 1959. The Parliament of Western Australia enacts as follows: Short title 1. This Act may be cited as the Metropolitan Region Town Planning Scheme Amendment Act 1998. 5 Commencement 2. This Act comes into operation on the day on which it receives the Royal Assent. No. 5 -- 1 Metropolitan Region Town Planning cl. 3 Scheme Amendment Bill 1998 The Act amended 3. The amendments in this Act are to the Metropolitan Region Town Planning Scheme Act 1959*. [* Reprinted as at 7 March 1996. 5 For subsequent amendments see 1997 Index to Legislation of Western Australia, Table 1, p. 150-1 and Act No. 31 of 1997.] Section 33 amended 4. (1) Section 33 (4) is amended -- 10 (a) by deleting ''12'' and inserting instead -- '' 14 ''; and (b) by deleting ''pass a resolution disallowing the amendment'' and inserting instead -- '' 15 pass a resolution -- (a) disallowing the whole of the amendment; or (b) disallowing any part of the amendment by deleting anything from 20 it ''. (2) After section 33 (5) the following subsection is inserted -- '' 25 (5a) If any part of the amendment is disallowed under subsection (4) (b) the amendment, subject to the 2 Metropolitan Region Town Planning Scheme Amendment Bill 1998 cl. 4 deletion of that part, shall have effect as mentioned in subsection (5). ''. (3) Section 33 (6) is repealed and the following subsections 5 are inserted instead -- '' (6) The Commission shall cause to be published in the Gazette within 21 days of the passing of a resolution under subsection (4) -- 10 (a) if paragraph (a) of that subsection applies, a notice of the disallowance of the whole of the amendment; or (b) if paragraph (b) of that subsection applies, a notice showing particulars of the partial 15 disallowance. (7) The Commission may make clerical changes to an amendment that are necessary as a consequence of a partial disallowance under subsection (4) (b). ''. 20
