Section 32 amended 5 190--1 page i Western Australia LEGISLATIVE ASSEMBLY Mandatory Testing (Infectious Diseases) Amendment (COVID-19 Response) Bill 2020 A Bill for An Act to amend the Mandatory Testing (Infectious Diseases) Act 2014 in response to the COVID-19 pandemic. The Parliament of Western Australia enacts as follows: page 1 Mandatory Testing (Infectious Diseases) Amendment (COVID-19 Response) Bill 2020 s. 1 1 1. Short title 2 This is the Mandatory Testing (Infectious Diseases) Amendment 3 (COVID-19 Response) Act 2020. 4 2. Commencement 5 This Act comes into operation as follows -- 6 (a) sections 1 and 2 -- on the day on which this Act 7 receives the Royal Assent; 8 (b) the rest of the Act -- on the day after that day. 9 3. Act amended 10 This Act amends the Mandatory Testing (Infectious Diseases) 11 Act 2014. 12 4. Section 3 amended 13 In section 3 delete "blood" (each occurrence). 14 5. Section 4 amended 15 (1) In section 4 delete the definition of qualified person. 16 (2) In section 4 insert in alphabetical order: 17 18 qualified person means -- 19 (a) the holder of -- 20 (i) a Certificate III in Pathology Collection 21 from a college as defined in the 22 Vocational Education and Training 23 Act 1996 section 5(1); or 24 (ii) an equivalent qualification from an 25 institution based in another State or 26 Territory or overseas; 27 or page 2 Mandatory Testing (Infectious Diseases) Amendment (COVID-19 Response) Bill 2020 s. 6 1 (b) in relation to the taking of a sample of a 2 particular type -- a person, or class of persons, 3 prescribed for the taking of that type of sample; 4 sample means a sample of blood, saliva, mucus, 5 respiratory secretions or other material taken from a 6 person; 7 8 6. Section 7 amended 9 In section 7(1) in the definition of disease test approval delete 10 "blood". 11 7. Section 10 amended 12 In section 10(2): 13 (a) in paragraph (b) delete "of the suspected transferor's 14 blood;" and insert: 15 16 from the suspected transferor; 17 18 (b) in paragraphs (d) and (e) delete "blood". 19 8. Section 12 amended 20 In section 12 delete "blood" (each occurrence). 21 9. Section 15 amended 22 In section 15 in the definition of disease test order delete 23 "blood". 24 10.
