Certain agreements not to be entered into 3 255--1 page i Western Australia LEGISLATIVE ASSEMBLY (Introduced by Mr Roger Cook, MLA) No Privatisation of Midland Health Campus Bill 2011 A Bill for An Act to prevent the privatisation of the Midland Health Campus by requiring it to be conducted or managed by the State as a public hospital. The Parliament of Western Australia enacts as follows: page 1 No Privatisation of Midland Health Campus Bill 2011 s. 1 1 1. Short title 2 This is the No Privatisation of Midland Health Campus 3 Act 2011. 4 2. Commencement 5 This Act comes into operation as follows -- 6 (a) sections 1 and 2 -- on the day on which this Act 7 receives the Royal Assent; 8 (b) the rest of the Act -- on the day after that day. 9 3. Object of this Act 10 The object of this Act is to prevent the Midland Health Campus 11 from being conducted or managed otherwise than by the State 12 as a public hospital. 13 4. Terms used 14 In this Act -- 15 Midland Health Campus means the hospital that is proposed to 16 have that name and to be built in the Midland Redevelopment 17 Area; 18 Midland Redevelopment Area means the redevelopment area as 19 defined in the Midland Redevelopment Act 1999 section 3; 20 public hospital has the meaning given in the Hospitals and 21 Health Services Act 1927 section 2(1). 22 5. Midland Health Campus to be conducted or managed as a 23 public hospital 24 A hospital that is established as the Midland Health Campus 25 must be conducted or managed by the State as a public hospital. page 2 No Privatisation of Midland Health Campus Bill 2011 s. 6 1 6. Certain agreements not to be entered into 2 (1) An agreement must not be entered into for a hospital established 3 as the Midland Health Campus to be conducted or managed 4 otherwise than by the State as a public hospital. 5 (2) An agreement entered into contrary to subsection (1) is void.
