A Bill for
An Act to amend the Petroleum Products Pricing Act 1983.
The Parliament of Western Australia enacts as follows:

1 1. Short title
2 This is the Petroleum Products Pricing Amendment Act 2019.
3 2. Commencement
4 This Act comes into operation as follows --
5 (a) sections 1 and 2 -- on the day on which this Act
6 receives the Royal Assent;
7 (b) the rest of the Act -- on a day fixed by proclamation.
8 3. Act amended
9 This Act amends the Petroleum Products Pricing Act 1983.
10 4. Section 22H replaced
11 Delete section 22H and insert:

13 22H. Terms used
14 (1) In this Division --
15 business includes the following --
16 (a) a business not carried on for profit;
17 (b) a trade or profession;
18 (c) the functions of a public body, other public
19 organisation or public office holder;
20 exempt sale has the meaning given in subsections (2)
21 and (3);
22 kind of motor fuel refers to the type of motor fuel and,
23 if there are different grades or brands of a particular
24 type of motor fuel, motor fuel of that type has to be of
25 the same grade and brand for it to be the same kind of
26 motor fuel;

1 standard retail price means the price at which the
2 motor fuel concerned is offered for retail sale without
3 any discounts or special offers.
4 (2) A retail sale of motor fuel at a particular place is an
5 exempt sale if --
6 (a) a business of hiring out, leasing out or selling
7 motor vehicles is carried on at the place and the
8 motor fuel is sold in the course of that business
9 incidentally to a hire, lease or sale of a motor
10 vehicle; or
11 (b) the motor fuel is sold in bulk to be delivered or
12 collected by tanker; or
13 (c) the motor fuel is sold for fuelling a motor
14 vehicle that is used for a business and not used
15 for any other purpose.
16 (3) The regulations may prescribe other cases in which a
17 retail sale of motor fuel at a particular place is an
18 exempt sale.

21 In section 22I(2) delete "in accordance with an existing
22 agreement or arrangement between the customer and the
23 retailer," and insert:
