Planning approval not required for certain METRONET works 5 Schedule 1 -- Line of Thornlie-Cockburn Link Schedule 2 -- Line of Yanchep Rail Extension Defined terms 70--1 page i Western Australia LEGISLATIVE ASSEMBLY Railway (METRONET) Bill 2018 A Bill for An Act to authorise, as part of the METRONET plan, the construction of -- • a railway from Beckenham junction to Cockburn (known as the Thornlie-Cockburn Link); and • a railway from Butler to Yanchep (known as the Yanchep Rail Extension), and for related purposes. The Parliament of Western Australia enacts as follows: page 1 Railway (METRONET) Bill 2018 Part 1 Preliminary s. 1 1 Part 1 -- Preliminary 2 1. Short title 3 This is the Railway (METRONET) Act 2018. 4 2. Commencement 5 This Act comes into operation on the day on which it receives 6 the Royal Assent. page 2 Railway (METRONET) Bill 2018 Authority to construct METRONET railways Part 2 s. 3 1 Part 2 -- Authority to construct METRONET 2 railways 3 3. Authority to construct Thornlie-Cockburn Link 4 A railway, with all necessary, proper and usual works and 5 facilities in connection with the railway, may be constructed and 6 maintained along the line described in Schedule 1. 7 4. Authority to construct Yanchep Rail Extension 8 A railway, with all necessary, proper and usual works and 9 facilities in connection with the railway, may be constructed and 10 maintained along the line described in Schedule 2. page 3 Railway (METRONET) Bill 2018 Part 3 Application of Metropolitan Region Scheme s. 5 1 Part 3 -- Application of Metropolitan Region Scheme 2 5. Terms used 3 In this Part -- 4 Bush Forever area means land identified as a Bush Forever 5 area in accordance with the Metropolitan Region Scheme 6 clause 28A(1); 7 METRONET railway means a railway the construction and 8 maintenance of which is authorised by Part 2; 9 METRONET works means works for the purpose of, or in 10 connection with, a METRONET railway but does not include 11 the construction or alteration of a railway station, or any related 12 car parks, public transport interchange facilities or associated 13 means of pedestrian or vehicular access; 14 Metropolitan Region Scheme has the meaning given in the 15 Planning and Development Act 2005 section 4(1); 16 non-railway land means -- 17 (a) land reserved under the Metropolitan Region Scheme 18 Part II for a public purpose other than railways; or 19 (b) land zoned under the Metropolitan Region Scheme 20 Part III; 21 Planning Commission means the Western Australian Planning 22 Commission established by the Planning and Development 23 Act 2005 section 7(1); 24 railway land means land reserved under the Metropolitan 25 Region Scheme Part II for the purpose of railways. page 4 Railway (METRONET) Bill 2018 Application of Metropolitan Region Scheme Part 3 s. 6 1 6. Planning approval not required for certain METRONET 2 works 3 Despite anything in the Metropolitan Region Scheme, the 4 following development may be commenced or carried out 5 without the approval of the Planning Commission -- 6 (a) METRONET works that involve the clearing of native 7 vegetation on railway land in a Bush Forever area; 8 (b) METRONET works on non-railway land. page 5 Railway (METRONET) Bill 2018 Schedule 1 Line of Thornlie-Cockburn Link 1 Schedule 1 -- Line of Thornlie-Cockburn Link 2 [s. 3] 3 The line of the railway commences at a point 12.776 km along the Armadale 4 railway line, at Beckenham junction and proceeds in a generally south westerly 5 direction for a distance of 17.5 km to a point, near Map Grid of Australia 6 coordinates 392267 East and 6445208 North, that is approximately 400 m north 7 of the intersection of Armadale Road and Kwinana Freeway, Cockburn Central. 8 The course to be taken by the railway is shown as a red line on Public Transport 9 Authority drawing no. 05-C-00-0023 Rev B. page 6 Railway (METRONET) Bill 2018 Line of Yanchep Rail Extension Schedule 2 1 Schedule 2 -- Line of Yanchep Rail Extension 2 [s. 4] 3 The line of the railway commences at a point 130 m north of existing Butler 4 station (Map Grid of Australia coordinates 376692 East and 6499335 North) 5 40.9 km from Perth along the Currambine-Butler railway line and proceeds in a 6 generally north westerly direction for a distance of 14.5 km to a point, near Map 7 Grid of Australia coordinates 371222 East and 6511677 North, that is 8 approximately 2 800 m north of the intersection of Marmion Avenue and 9 Yanchep Beach Road, Yanchep. 10 The course to be taken by the railway is shown as a red line on Public Transport 11 Authority drawing no. 14-C-00-0004 Rev B. 12 page 7 Railway (METRONET) Bill 2018 Defined terms Defined terms [This is a list of terms defined and the provisions where they are defined.
