Radiation Safety Amendment Bill 2014 A Bill for An Act to amend the Radiation Safety Act 1975 to provide for the prohibition of sun-tanning units. The Parliament of Western Australia enacts as follows: page 1 Radiation Safety Amendment Bill 2014 s. 1 1 1. Short title 2 This is the Radiation Safety Amendment Act 2014. 3 2. Commencement 4 This Act comes into operation as follows -- 5 (a) sections 1 and 2 -- on the day on which this Act 6 receives the Royal Assent (assent day); 7 (b) the rest of the Act -- on the last day of the period of 8 3 months after assent day. 9 3. Act amended 10 This Act amends the Radiation Safety Act 1975. 11 4. Section 4 amended 12 (1) In section 4 insert in alphabetical order: 13 14 sun-tanning unit means an electronic product that -- 15 (a) is capable of producing ultraviolet radiation 16 between 100 nm and 400 nm wavelength; and 17 (b) designed to produce tanning of human skin; and 18 (c) is provided for tanning the skin of a person -- 19 (i) for fee or reward; or 20 (ii) as part of providing a service for fee or 21 reward. 22 23 (2) In section 4 in the definition of sell delete "accordingly." and 24 insert: 25 26 accordingly; 27 page 2 Radiation Safety Amendment Bill 2014 s. 5 1 5. Section 6 amended 2 After section 6(1)(b) insert: 3 4 (ba) sun-tanning units; 5 6 6. Section 7 amended 7 In section 7(1) delete "apparatus" and insert: 8 9 apparatus, sun-tanning unit 10 11 7. Part IIIA inserted 12 After section 24A insert: 13 14 Part IIIA -- Sun-tanning units 15 24B. Offence to provide or operate sun-tanning unit 16 A person commits an offence if the person -- 17 (a) provides, or offers to provide, the use of a 18 sun-tanning unit; or 19 (b) operates, or offers to operate, a sun-tanning 20 unit. 21 24C. Transitional arrangements 22 (1) In this section -- 23 commencement day means the day the Radiation 24 Safety Amendment Act 2014, other than sections 1 25 and 2, comes into operation; 26 solarium means premises, or part of premises, in which 27 a sun-tanning unit is used or operated. page 3 Radiation Safety Amendment Bill 2014 s. 8 1 (2) Registration of a solarium or sun-tanning unit effected 2 under this Act prior to commencement day ceases to 3 have effect on commencement day. 4 (3) The Minister may pay to a person in whose name the 5 registration of a sun-tanning unit was effected before 6 commencement day compensation of an amount 7 determined by the Minister for the early termination of 8 the registration of the sun-tanning unit. 9 10 8. Section 59 amended 11 In section 59(b) delete "products;" and insert: 12 13 products other than sun-tanning units; 14 15
