A Bill for
An Act to amend the Retail Trading Hours Act 1987 and for related
purposes.
The Parliament of Western Australia enacts as follows:

1 1. Short title
2 This is the Retail Trading Hours Amendment Act 2012.
3 2. Commencement
4 This Act comes into operation as follows --
5 (a) sections 1 and 2 -- on the day on which this Act
6 receives the Royal Assent;
7 (b) the rest of the Act -- on a day fixed by proclamation.
8 3. Act amended
9 This Act, other than section 7, amends the Retail Trading Hours
10 Act 1987.
11 4. Section 12 amended
12 (1) Delete section 12(3)(c) and insert:

14 (c) on Sunday in each week, until 11 a.m. and from
15 and after 5 p.m.; and
16
17 (2) In section 12(4):
18 (a) in paragraph (a) delete "special trading precinct or";
19 (b) delete paragraph (b).
20 5. Section 12A amended
21 (1) In section 12A(1) and (2) delete "special trading precinct or"
22 (each occurrence).
23 (2) Delete section 12A(3).
24 (3) In section 12A(4) delete the definitions of:

5 (4) Delete section 12A(5).
6 Note: The heading to amended section 12A is to read:
7 Trading hours for general retail shops in holiday resorts
8 6. Section 12E amended
9 (1) Delete section 12E(2) and insert:

11 (2) Without limiting the effect of subsection (3A), but
12 despite any other provision of this section, an order can
13 vary the trading hours of general retail shops in the
14 metropolitan area only in relation to a day that is --
15 (a) within the period of 28 days ending on
16 1 January; or
17 (b) a public holiday or public half-holiday outside
18 that period.
19 (3A) An order cannot authorise general retail shops in the
20 metropolitan area to be open on Anzac Day (25 April),
21 Christmas Day (25 December) or Good Friday.

23 (2) In section 12E(3) delete "Subject to subsection (2), an" and
24 insert:
