WESTERN AUSTRALIA LEGISLATIVE ASSEMBLY (Introduced by Dr Gallop) TOWN PLANNING AND DEVELOPMENT AMENDMENT BILL 1997 A BILL FOR AN ACT to require reasons for the Minister's determinations on appeal under the Town Planning and Development Act 1997. The Parliament of Western Australia enacts as follows: Short title 1. This Act may be cited as the Town Planning and Development Amendment Act 1997. No. 62 -- 1 Town Planning and Development Amendment Bill 1997 Commencement 2. This Act comes into operation on the day on which it receives the Royal Assent. Principal Act 5 3. In this Act the Town Planning and Development Act 1928* is referred to as the principal Act. [*Reprinted as at 21 February 1996.] New section 54DD inserted 4. The principal Act is amended by inserting after section 54D 10 the following -- '' Written reasons for determination of appeals by Minister and publication thereof 54DD. The Minister -- 15 (a) shall give to the parties to an appeal to the Minister written reasons for the determination of the Minister on the appeal; and (b) shall publish those reasons in the Gazette within 14 days of such determination taking effect; and 20 (c) shall, upon payment of a fee determined in the manner prescribed, supply a copy of those reasons to any other person. ''.
