is to be examined by a medical practitioner agreed upon by the
impairment review committee and the teacher.
         (2) If the impairment review committee and the teacher are unable
to agree upon the person to conduct the examination, the

committee that the disclosure to the teacher of information in
the report might be prejudicial to the physical or mental health
or wellbeing of the teacher, the committee may decide not to
give that report to the teacher but to give it instead to a medical
practitioner, or another teacher, nominated by the teacher.
