Giz Watson, MLC) Uranium Mining (Implementation of Government Commitments) Bill 2007 A Bill for An Act to prohibit the mining of uranium in Western Australia. The Parliament of Western Australia enacts as follows: page 1 Uranium Mining (Implementation of Government Commitments) Bill 2007 s. 1 1. Short title This is the Uranium Mining (Implementation of Government Commitments) Bill 2007. 2. Commencement 5 This Act comes into operation on Royal Assent. 3. The Act amended The amendments in this Act are to the Mining Act 1978. 4. Section 154A inserted After section 154 the following section is inserted -- 10 " 154A Penalties (1) A person who mines uranium commits an offence. Penalty: $500,000 and if the offence is a continuing one, to a further fine of $50,000 for every day or part 15 of a day during which the offence has continued. (2) It is a defence to a charge under this section to show that the accused person -- (a) Mined the uranium under the authority of a mining lease granted on or before 20 22 June 2002; or (b) Mined the uranium incidentally to the mining of other minerals and not for the purpose of sale.
