5 (5) A complaint about a person may be made and dealt with even

10 (1) A complaint may be made about the conduct of a person

13 (2) However, the Board cannot deal with a complaint if the
14 complaint is made more than 3 years after the conduct that is the

16 Board determines that --
17 (a) it is just and fair to deal with the complaint having
18 regard to the delay and the reasons for the delay; and
19 (b) it is in the public interest to deal with the complaint.
20 (3) A determination under subsection (2) is final and cannot be

22 respondent.

23 83. Respondent to be notified about complaint
24 (1) The Board must give written notice to a respondent that a
25 complaint has been made about the respondent as soon as
26 practicable after the complaint is made.
27 (2) The notice must --

29 (b) subject to subsection (3), identify the complainant.

3 any reasons provided by the complainant under section 81(4)(d).
4 (4) The Board is not required to give notice under subsection (1) if

15 or tribunal.
16 (5) In a case to which subsection (4) applies, the Board may --
17 (a) postpone giving the respondent notice of the complaint
18 until the Board considers it appropriate to do so; or
19 (b) give the respondent a notice setting out the general
20 nature of the complaint.
21 (6) Nothing in this section requires the Board to give notice to the
22 respondent until the Board has had a reasonable opportunity to
23 assess the complaint, seek further information about the

16 of a person authorised to commence proceedings.
17 (4) Subsection (1) does not limit the ability of a person to
18 commence or conduct the prosecution of an offence under this
19 Act if the person has authority at law to do so.

20 141. Time limit for commencing prosecutions
21 (1) A prosecution for an offence under this Act must be
22 commenced within 2 years after the day on which the offence

11 (2) If a body corporate is guilty of an offence to which this section
12 applies, an officer of the body corporate is also guilty of the
13 offence if the officer failed to take all reasonable steps to
14 prevent the commission of the offence by the body corporate.
15 (3) In determining whether things done or omitted to be done by the

1 (4) A code of practice issued under this section may apply, adopt or
2 incorporate any matter contained in a document issued or
3 published by a person or body --
4 (a) with or without modification; and
5 (b) whether in force at a particular time or from time to
6 time.
7 (5) The Board must publish a notice in the Gazette giving details

9 (a) the issue, amendment or revocation of a code of practice

11 (b) where copies of the code, including any revision of the
12 code and any document incorporated in it by reference,
13 have been made available under subsection (3).
14 (6) A code of practice issued under this section is not subsidiary
15 legislation for the purposes of the Interpretation Act 1984.
16 (7) If there is a conflict or inconsistency between a provision of the
17 regulations and a provision of a code of practice issued under
18 this section, the provision of the regulations prevails.

19 198. Breach of code of practice
20 (1) A breach of a code of practice issued under section 197 does not
21 of itself constitute unprofessional conduct or professional
22 misconduct but in any proceedings under Part 7 such a breach
23 may be asserted and may be taken into account in dealing with
24 the complaint.
25 (2) However, no civil or criminal liability attaches to a person by
26 reason only that the person has committed a breach of a code of
27 practice issued under section 197.
