          Young Offenders Amendment Bill 2003


                                    A Bill for


    An Act to amend the Young Offenders Act 1994.



    The Parliament of Western Australia enacts as follows:


    1.      Short title
            This Act may be cited as the Young Offenders Amendment Act
5           2003.

     2.          Act amended
                 The amendments in this Act are to the Young Offenders
                 Act 1994.

     3.          Section 55 amended
5                After section 55(4) the following subsection is inserted --
            "
                (4a)   Although a conviction is not recorded and no
                       punishment is imposed, the offender is deemed to have
                       been convicted for the purpose of the application of
10                     section 401(4) of The Criminal Code to the sentencing
                       of the offender for another offence.
                                                                                  ".

     4.          Section 189 amended
                 After section 189(8)(d) the following paragraph is inserted --
15                     "
                           (e)   the obligation of a Court to impose a sentence
                                 of imprisonment or detention under
                                 section 401(4) of The Criminal Code.
                                                                                  ".
