The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Navigation (Consequential
6
Amendments) Act 2012.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

A Proclamation must not specify a day that
occurs before the day the Maritime Labour
Convention, 2006, done at Geneva on
23 February 2006, comes into force for
Australia.
However, if the provision(s) do not
commence within the period of 6 months
beginning on the day the Convention comes
into force for Australia, they commence on
the day after the end of that period. If the
provision(s) commence in this way, the
Minister must announce by notice in the
Gazette the day the provision(s)
commenced. The notice is not a legislative
instrument.
Note:
This table relates only to the provisions of this Act as originally

enacted. It will not be amended to deal with any later amendments of

this Act.

(a) a vessel, or a structure other than a vessel that is able to float

one place to another, that is used or intended for use wholly

with or incidental to, exploring or exploiting the mineral and
30
other non-living resources of:
31
(i) the continental shelf of Australia; or

(ii) the seabed of the coastal sea of Australia or the subsoil

of that seabed;

by drilling, or by obtaining substantial quantities of material

(b) a barge or similar vessel fitted with living quarters for more
6
than 12 persons and used or intended for use wholly or
7
primarily in connection with the construction, maintenance or
8
repair of off-shore industry fixed structures.

(ii) is covered by a declaration in force under
7
subsection (3AB) of this section.

(3AA) However, this Act does not apply because of subsection (3) to a
9
vessel or ship that is covered by a declaration in force under
10
subsection (3AC).

(3AB) The Authority may declare in writing that this Act applies to a
12
vessel or ship that would be an off-shore industry vessel, or a
13
trading ship, within the meaning of the Navigation Act 1912 if that
14
Act had not been repealed.
15
(3AC) The Authority may declare in writing that this Act does not apply
16
because of subsection (3) to a vessel or ship that would be an
17
off-shore industry vessel, or a trading ship, within the meaning of
18
the Navigation Act 1912 if that Act had not been repealed.
19
(3AD) A declaration made under subsection (3AB) or (3AC) is not a
20
legislative instrument.

waters that are outside the outer limits of the exclusive
6
economic zone of Australia but within the Protected Zone;
7
and
8
(c) the ship is not otherwise present in waters that are outside the
9
outer limits of the exclusive economic zone of Australia.

Protected Zone means the zone that is:

(a) established under Article 10 of the Treaty between Australia

and the Independent State of Papua New Guinea concerning

Sovereignty and Maritime Boundaries in the area between

the two Countries, including the area known as Torres Strait,

and Related Matters, done at Sydney on 18 December 1978,
18
as amended and in force for Australia from time to time; and
19
(b) the area bounded by the line described in Annex 9 to that
20
Treaty.
