The Parliament of Australia enacts:

1 Short title
5
This Act is the Narcotic Drugs (Licence Charges) Act 2016.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Schedule 1 to the Narcotic Drugs
Amendment Act 2016; and

Note:
This table relates only to the provisions of this Act as originally

enacted. It will not be amended to deal with any later amendments of

this Act.

Information may be inserted in this column, or information in it

3 Definitions

In this Act:
9
charge means charge imposed by this Act.
10
licence means a licence granted under the Narcotic Drugs Act
11
1967.

4 Crown to be bound
13
This Act binds the Crown in each of its capacities. However, it
14
does not bind the Crown in right of the Commonwealth.
15
5 Extension to external Territories
16
This Act extends to every external Territory.

6 Imposition of charge
1
(1) Charge is imposed on a licence that is in force at whichever of the
2
following times is applicable:

(a) any time during a financial year;
4
(b) any time during such other period as is prescribed by the
5
regulations.

(2) Without limiting subsection (1), the regulations may prescribe
7
different periods in relation to the following:
8
(a) different classes of licence;
9
(b) licences of the same class that authorise different activities.

7 By whom charge payable
11
Charge imposed on a licence is payable by the holder of the
12
licence.

8 Amount of charge

(1) The amount of the charge for a period is such amount as is
15
prescribed by the regulations.

(2) Without limiting subsection (1), the regulations may prescribe
17
different charges in relation to the following:
18
(a) different classes of licence;
19
(b) licences of the same class that authorise different activities.

(3) In this section:

amount includes a nil amount.

9 Regulations

The Governor-General may make regulations prescribing matters:
24
(a) required or permitted by this Act to be prescribed; or
25
(b) necessary or convenient to be prescribed for carrying out or
26
giving effect to this Act.
