The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the National Disability Insurance Scheme
6
Savings Fund Special Account Act 2016.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10

3 Definitions

In this Act:

National Disability Insurance Scheme Launch Transition
12
Agency means the National Disability Insurance Scheme Launch
13
Transition Agency established by section 117 of the National
14
Disability Insurance Scheme Act 2013.

National Disability Insurance Scheme Savings Fund Special
16
Account means the National Disability Insurance Scheme Savings
17
Fund Special Account established by section 5.

4 Main object of Act
19
The main object of this Act is to assist the Commonwealth to meet
20
its funding obligations in relation to the National Disability
21
Insurance Scheme Act 2013.

5 Establishment of the National Disability Insurance Scheme

Savings Fund Special Account

(1) The National Disability Insurance Scheme Savings Fund Special
3
Account is established by this section.

(2) The National Disability Insurance Scheme Savings Fund Special
5
Account is a special account for the purposes of the Public
6
Governance, Performance and Accountability Act 2013.

6 Purposes of the National Disability Insurance Scheme Savings
8
Fund Special Account
9
Each of the following is a purpose of the National Disability
10
Insurance Scheme Savings Fund Special Account:
11
(a) to assist the Commonwealth to meet its funding obligations
12
in relation to the National Disability Insurance Scheme Act
13
2013;
14
(b) to make payments to the National Disability Insurance
15
Scheme Launch Transition Agency for the purposes of the
16
Agency;
17
(c) to reduce the balance of the Account (and, therefore, the
18
available appropriation for the Account) without making a
19
real or notional payment.

Accountability Act 2013 (which deals with special accounts).

7 Credits to Special Account--determinations by the Minister
23
(1) The Minister may, by writing, determine that:
24
(a) a specified amount is to be credited to the National Disability
25
Insurance Scheme Savings Fund Special Account on a
26
specified day; or
27
(b) a specified amount is to be credited to the National Disability
28
Insurance Scheme Savings Fund Special Account in specified
29
instalments on specified days.

(2) A determination under subsection (1) is not a legislative

instrument.

8 Delegation by the Minister
3
(1) The Minister may, by writing, delegate any or all of his or her
4
powers under section 7 to:
5
(a) the Secretary of the Department; or
6
(b) an SES employee, or acting SES employee, in the
7
Department.

Note:
The expressions SES employee and acting SES employee are defined
9
in section 2B of the Acts Interpretation Act 1901.
10
(2) In exercising powers under a delegation, the delegate must comply
11
with any directions of the Minister.

9 Review of operation of Act
13
The Minister must cause a review of the operation of this Act to be
14
undertaken in the financial year ending on 30 June 2027.
