A Bill for an Act to amend the National Health 

Reform Act 2011, and for related purposes 

The Parliament of Australia enacts: 

1  Short title 

 

  This Act may be cited as the National Health Reform Amendment 

(Definitions) Act 2013

2  Commencement 

 

  This Act commences on the day this Act receives the Royal 

Assent. 

3  Schedule(s)

  Each Act that is specified in a Schedule to this Act is amended or 

11 

repealed as set out in the applicable items in the Schedule 

12

concerned, and any other item in a Schedule to this Act has effect 

according to its terms.

Amendments 

   

National Health Reform Act 2011 

1  Section 5 (definitions of local hospital network

Repeal the definitions, substitute: 

local hospital network means an organisation that is a local 

hospital network (however described) for the purposes of the 

National Health Reform Agreement. 

2  Section 5 (definition of primary health care organisation

Repeal the definition, substitute:

primary health care organisation means a body or organisation 

11 

prescribed in an instrument under subsection 5A(1).

3  Section 5 (definition of private hospital

13 

Repeal the definition, substitute: 

14 

private hospital means: 

15 

 

(a)  a hospital within the meaning of subsection 121-5(5) of the 

16 

Private Health Insurance Act 2007, where the statement 

17 

under subsection 121-5(8) of that Act is that the hospital is a 

18 

private hospital; or 

19 

 

(b)  a body or organisation prescribed in an instrument under 

20 

subsection 5A(2).

4  Section 5 (definition of public hospital

22 

Repeal the definition, substitute: 

23 

public hospital means: 

24 

 

(a)  a body or organisation to which a provision (including a 

25 

definition) of a law of a State, the Australian Capital 

26 

Territory or the Northern Territory applies, being a provision 

27 

prescribed in an instrument under subsection 5A(3); or 

28 

 

(b)  a body or organisation prescribed in an instrument under 

29 

subsection 5A(5); or 

30 

 

(c)  in relation to a State, the Australian Capital Territory or the 

31 

Northern Territory in respect of which neither paragraph (a)

nor (b) applies--a public hospital (within the ordinary 

meaning of that expression). 

5  After section 5 

Insert: 

5A  Legislative instruments for definitions of primary health care 

organisationprivate hospital and public hospital 

Primary health care organisation 

 

(1)  The Minister may, by legislative instrument, prescribe bodies or 

organisations for the purposes of the definition of primary health 

care organisation in section 5.

Private hospital

(2)  The Minister may, by legislative instrument, prescribe bodies or 

12 

organisations for the purposes of paragraph (b) of the definition of 

13 

private hospital in section 5. 

14 

 Public hospital 

15 

 

(3)  The Minister may, by legislative instrument, prescribe a provision 

16 

(including a definition) of a law of a State, the Australian Capital 

17 

Territory or the Northern Territory for the purposes of 

18 

paragraph (a) of the definition of public hospital in section 5. 

19 

 

(4)  However, before prescribing in an instrument under subsection (3) 

20 

a provision (including a definition) of a law of a State, the 

21 

Australian Capital Territory or the Northern Territory, the Minister 

22 

must consult the State/Territory Health Minister of the State or 

23 

Territory. 

24 

 

(5)  The Minister may, by legislative instrument, prescribe bodies or 

25 

organisations for the purposes of paragraph (b) of the definition of 

26 

public hospital in section 5. 

27 

 

(6)  However, the Minister must not prescribe in an instrument under 

28 

subsection (5) a body or organisation located in a State, the 

29 

Australian Capital Territory or the Northern Territory without the 

30 

written agreement of the State/Territory Health Minister of the 

31 

State or Territory.

6  Subsection 62(1) 

Omit "entities or facilities". 

7  Subsection 62(6) (heading) 

Omit "entity or facility", substitute "network or hospital".
