The Parliament of Australia enacts:

1 Short title
4
This Act is the National Land Transport Amendment (Best
5
Practice Rail Investment) Act 2017.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Omit "The matters to which the Minister may have regard in deciding

whether it is appropriate to approve a project as an Investment Project
6
include, but are not limited to, the following matters:", substitute "The
7
Minister must have regard to the following matters in deciding whether
8
it is appropriate to approve a project as an Investment Project:".

2 At the end of section 11

Add:

(g) if the project involves the construction of a new railway, or
12
the upgrade of an existing railway:
13
(i) the extent to which the project prioritises passenger rail
14
services, demonstrates best practice in rail infrastructure
15
investment and maximises the community benefits from
16
Commonwealth investment; and
17
(ii) the extent to which the project can lift the level of
18
service and standard of existing rail infrastructure to
19
maximise the benefit to communities along the railway
20
(for example by facilitating better passenger services);
21
(h) the extent to which the project maximises rural and regional
22
economic and social development benefits;
23
(i) the extent to which the project meets, or will meet, the
24
current and future needs of the users of infrastructure;
25
(j) any other matter that is relevant to the decision.

(aa) set out the reasons why the Minister has decided that it is

appropriate to approve the project; and

(4) The Secretary must publish:
1
(a) the project approval instrument for an Investment Project;
2
and
3
(b) a summary of the evidence on which the Minister's decision
4
that it is appropriate to approve the project as an Investment
5
Project is based;
6
on the Department's website as soon as practicable after the
7
instrument is made.

(5) The Minister must table before each House of the Parliament, a
9
copy of:
10
(a) the project approval instrument for an Investment Project;
11
and
12
(b) a summary of the evidence on which the Minister's decision
13
that it is appropriate to approve the project as an Investment
14
Project is based;
15
on the next sitting day of the House after those documents are
16
published under subsection (4).

5 Application
18
The amendments made by this Schedule apply to the approval of
19
projects as Investment Projects on or after the commencement of the
20
Schedule.
