A Bill for an Act to deal with consequential matters 

arising from the enactment of the News Media 

(Self-regulation) Act 2013, and for other purposes 

The Parliament of Australia enacts: 

1  Short title 

 

  This Act may be cited as the News Media (Self-regulation) 

(Consequential Amendments) Act 2013

2  Commencement 

 

(1)  Each provision of this Act specified in column 1 of the table 

commences, or is taken to have commenced, in accordance with 

10 

column 2 of the table. Any other statement in column 2 has effect 

11 

according to its terms.

2.  Schedule 1 

The day after the end of the period of 1 

month beginning on the first day before 

28 June 2013 on which a declaration under 

subsection 7(1) of the News Media 

(Self-regulation) Act 2013 takes effect. 

However, if no declaration under 

subsection 7(1) of the News Media 

(Self-regulation) Act 2013 takes effect 

before 28 June 2013, the provision(s) 

commence on 1 July 2013. 

However, the provision(s) do not commence 

at all if section 3 of the News Media 

(Self-regulation) Act 2013 has not 

commenced before 28 June 2013. 

 

Note:  

This table relates only to the provisions of this Act as originally 

enacted. It will not be amended to deal with any later amendments of 

this Act. 

 

(2)  Any information in column 3 of the table is not part of this Act. 

Information may be inserted in this column, or information in it 

may be edited, in any published version of this Act. 

3  Schedule(s) 

 

  Each Act that is specified in a Schedule to this Act is amended or 

repealed as set out in the applicable items in the Schedule 

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

Amendments 

   

Privacy Act 1988 

1  At the end of subsection 7B(4) 

Add: 

 

; and (c)  if the organisation is a news media organisation (within the 

meaning of the News Media (Self-regulation) Act 2013)--at a 

time when: 

 

(i)  the organisation is a member of a news media 

self-regulation body (within the meaning of that Act);

and

(ii)  the organisation's rights as a member of the news media 

12 

self-regulation body are not suspended under the body's 

13 

constitution.

2  After subsection 7B(4)

Insert:

(4A)  Paragraph (4)(c) does not apply to the extent (if any) that it would 

17 

infringe any constitutional doctrine of implied freedom of political 

18 

communication.
