1 Definitions

(1)
In this Schedule:

applies
, in relation to an enterprise agreement, has the same meaning as

in the
Fair Work Act 2009
.

covers
, in relation to an enterprise agreement, has the same meaning as

in the
Fair Work Act 2009
.

DCCEEW Enterprise Agreement
means the
Department of Climate
11
Change, Energy, the Environment and Water Enterprise Agreement
12
2024-2027
approved by the Fair Work Commission, as in operation
13
immediately before the transition time.

designated person
means:
15
(a) the Minister; or
16
(b) the Secretary of the Department; or
17
(c) an SES Band 3 employee (within the meaning of clause 17 of
18
Schedule 1 to the
Environment Protection and Biodiversity
19
Conservation Act 1999
as in force immediately before the
20
transition time).

environmental law
means:
22
(a) the
Environment Protection and Biodiversity Conservation

Act 1999
; or
24
(b) the
Environment Protection (Sea Dumping) Act 1981

function, power or duty is a function, power

or duty that:

(a) immediately before the transition time, was conferred or

imposed on one or more persons under an environmental law,
9
or under a legislative instrument made under an
10
environmental law, as in force before the transition time; but
11
(b) immediately after the transition time, is conferred or imposed
12
by the environmental law, or by the legislative instrument, on
13
the CEO instead, or the CEO and one or more of those
14
persons.

transition time
means the commencement of this item.

(2)
An expression used in this Schedule that is defined for the purposes of
17
the
Nature Positive (Environment Protection Australia) Act 2024
has
18
the same meaning in this Schedule as it has in that Act.

2 Transfer of documents and records to EPA
4
(1)
This item applies to a document or record if:
5
(a) immediately before the transition time, the document or
6
record was in the possession of the Department; and
7
(b) the document or record was:
8
(i) given to or received by the Department; or
9
(ii) brought into existence;
10
for the purposes of the performance of a transferred function
11
or a transferred duty or the exercise of a transferred power.
12
(2)
The documents and records are to be transferred to EPA after the
13
transition time.
14
(3)
For the purposes of the definitions of
protected information
and
15
relevant information
in section 5 of the
Nature Positive (Environment
16
Protection Australia) Act 2024
, any document or record that is
17
transferred under subitem (2) of this item is taken to be information
18
obtained by an entrusted person under, or in accordance with, that Act.
19
3 DCCEEW Enterprise Agreement
20
(1)
From the transition time, the DCCEEW Enterprise Agreement:
21
(a) continues to cover and apply to APS employees who:
22
(i) it covered and applied to immediately before the
23
transition time; and
24
(ii) at the transition time, are APS employees in EPA; and
25
(b) covers and applies to APS employees in EPA at the
26
classification levels covered by the DCCEEW Enterprise
27
Agreement whose employment in EPA commences at or
28
after the transition time; and
29
(c) covers and applies to the CEO as the Agency Head (within
30
the meaning of the
Public Service Act 1999
) of
the APS
31
employees in EPA; and

(d) has effect in relation to EPA, at and after the transition time,

as if:

(i) a reference to the Secretary of the Department were a
3
reference to the CEO; and
4
(ii) a reference to the Department were a reference to EPA.

(2)
Subitem (1) does not:
6
(a) prevent the variation or termination of the DCCEEW
7
Enterprise Agreement, as it covers and applies to APS
8
employees in EPA and the CEO, in accordance with law; or
9
(b) prevent the terms and conditions of employment of APS
10
employees in EPA from being varied at or after the transition
11
time:
12
(i) in accordance with those terms and conditions; or
13
(ii) by or under a law; or
14
(c) affect the operation of section 58 of the
Fair Work Act 2009
.

Note:
Section 58 of the
Fair Work Act 2009
deals with the interaction between one or more
16
enterprise agreements.

4 First review of the
Nature Positive (Environment Protection
2
Australia) Act 2024

For the purposes of the first review conducted under section 60 of the
4
Nature Positive (Environment Protection Australia) Act 2024
, the
5
reference in subsection 60(2) of that Act to the period since the previous
6
review was completed is taken to be a reference to the period since that
7
Act commenced.
8
5 Things done by or in relation to designated person
9
(1)
This item applies if:
10
(a) at a time (the
initial time
) before the transition time, a thing
11
was done by, or in relation to, a designated person under an
12
environmental law; and
13
(b) immediately after the transition time, the environmental law
14
provides for that thing to be done by, or in relation to, the
15
CEO instead of the designated person because of
16
amendments made by any of Schedules 2 to 10 of this Act.
17
(2)
The thing has effect, and may be dealt with, after the transition time as
18
if it had been done at the initial time by or in relation to the CEO, under
19
the environmental law as in force immediately after the transition time.
20
6 References in permit conditions, instruments etc. to
21
designated person
22
(1)
This item applies if:
23
(a) because of item 5, any of the following things have effect
24
after the transition time as if the thing had been done by the
25
CEO:
26
(i) a permit, licence or other authorisation (however
27
described) issued by a designated person;
28
(ii) an instrument (other than a legislative instrument) made
29
by a designated person;
30
(iii) an agreement entered into by a designated person; and
31
(b) a condition of the permit, licence or other authorisation, or a
32
provision of the instrument or agreement, refers to a thing

From the transition time, the provision has effect as if the reference

were to the thing being done by or in relation to the CEO.

7 Amendments relating to disclosure of information
5
The following provisions, as in force from the transition time, apply to
6
the disclosure of information from the transition time, whether the
7
information was obtained before, at or after that time:
8
(a) section 519A of the
Environment Protection and Biodiversity
9
Conservation Act 1999
;
10
(b) section 39A of the
Environment Protection (Sea Dumping)
11
Act 1981
;
12
(c) paragraph 43(1)(a) of the
Product Emissions Standards Act
13
2017
;
14
(d) section 54A of the
Underwater Cultural Heritage Act 2018
.

8 Pending proceedings
16
(1)
This item applies if:
17
(a) immediately before the transition time, a designated person is
18
a party to proceedings instituted by, or against, the designated
19
person under an environmental law in any court or tribunal;
20
and
21
(b) immediately after the transition time, those kinds of
22
proceedings may be instituted by, or against, the CEO instead
23
of the designated person under the environmental law
24
because of amendments made by any of Schedules 2 to 10 of
25
this Act.
26
(2)
The CEO is, from the transition time, substituted for the designated
27
person as a party to the proceedings.
28
9 Application of certain exceptions for notifying actions
29
under the
Environment Protection and Biodiversity
30
Conservation Act 1999
31
(1)
This item applies in relation to an action, whether taken before or after
32
the transition time, if:

(a) the action is in a class of actions specified in an agreement or
1
arrangement between the Secretary and a Commonwealth
2
agency, or an agency of a State or self-governing Territory;
3
and
4
(b) the agreement or arrangement provides the class of actions is
5
to be notified to the Secretary by the agency; and
6
(c) the agreement or arrangement was entered into before the
7
transition time.

(2)
Paragraphs 199(4)(b), 214(4)(b), 232(4)(b) and 256(4)(b) of the
9
Environment Protection and Biodiversity Conservation Act 1999
have
10
effect after the transition time in relation to the action as if the
11
agreement or arrangement provided that the class of actions were to be
12
notified to the CEO by the agency.
13
10 Retention of seized things
14
(1)
This item applies in relation to a thing, whether seized before or after
15
the transition time, if:
16
(a) the Minister or Secretary is authorised by a law, or an order
17
of a court, of the Commonwealth or of a State or Territory to
18
retain, destroy, dispose of or otherwise deal with a thing; and
19
(b) the law or court order was in force immediately before the
20
transition time.
21
(2)
The following provisions have effect after the transition time in relation
22
to the thing as if the law or court order also authorised the CEO to
23
retain, destroy, dispose of or otherwise deal with the thing:
24
(a) the following provisions of the
Environment Protection and
25
Biodiversity Conservation Act 1999
:
26
(i) paragraph 438(4)(c);
27
(ii) paragraph 444G(4)(c);
28
(iii) paragraph 446(1C)(d);
29
(iv) paragraph 456AB(4)(d);
30
(v) paragraph 456AC(4)(c);
31
(b) paragraph 66(3)(c) of the
Regulatory Powers (Standard

Provisions) Act 2014
.

11 Transitional rules
2
(1)
The Minister may, by legislative instrument, make rules prescribing
3
matters of a transitional nature (including prescribing any saving or
4
application provisions) relating to:
5
(a) the amendments or repeals made by Schedules 2 to 12 of this
6
Act; or
7
(b) the enactment of this Act or the
Nature Positive
8
(Environment Protection Australia) Act 2024
; or
9
(c) the application of the DCCEEW Enterprise Agreement, as it
10
applies in relation to the EPA in accordance with Part 2 of
11
this Schedule.

(2)
The rules may modify the effect of Part 3 of this Schedule in relation to
13
a specified matter or thing. However, any rules that do so must be made
14
before the end of the period of 12 months beginning on the day this item
15
commences.
16
(3)
To avoid doubt, the rules may not do the following:
17
(a) create an offence or civil penalty;
18
(b) provide powers of:
19
(i) arrest or detention; or
20
(ii) entry, search or seizure;
21
(c) impose a tax;
22
(d) set an amount to be appropriated from the Consolidated
23
Revenue Fund;
24
(e) directly amend the text of this Act or the
Nature Positive
25
(Environment Protection Australia) Act 2024
.
26
(4)
This Act (other than subitem (3) of this item) does not limit the rules
27
that may be made for the purposes of subitem (1) of this item.

(4) The notice must specify:

(a) the matters to be covered by the audit; and

(b) the form of the audit report and the kinds of particulars it is to
15
contain; and
16
(c) the day on or before which the report must be given to the
17
Minister; and
18
(d) any other matters prescribed by the regulations.
19
(5) Without limiting the matters that may be specified for the purposes
20
of paragraph (4)(a), those matters may include all or any of the
21
following:
22
(a) an evaluation of the nature of the environment that is or will
23
be affected by the activities, of the person, to which the
24
environmental authority, environmental exemption or
25
environmental order is relevant;
26
(b) an assessment of the risks to the environment resulting from
27
those activities;
28
(c)
an assessment of the person's existing capacity, in carrying
29
on those activities, to comply with:
30
(i) for an environmental authority
--
any conditions of the
31
authority; and
32
(ii) for an environmental order
--
the order; and
33
(iii) in any case
--
the requirements of this Act and the
34
regulations;

459 Appointment of auditor and conducting an audit
3
(1) A person who is given notice under section 458 (the
audited
4
person
) must:

(a) appoint a person to conduct the audit required by the notice;
6
and
7
(b) arrange for the person appointed (the
auditor
) to conduct the

audit in accordance with the notice.
9
Civil penalty:
500 penalty units.

(2) The person appointed to conduct the audit must be:

(a) a registered auditor; or
12
(b) if no registered auditor is reasonably available to conduct the
13
audit

a person who the Minister has approved for such

appointment before the appointment is made.

(3) The Minister may, in writing, approve a person for the purposes of
16
paragraph (2)(b) if:
17
(a) the person approved is not an officer or employee of the
18
audited person; and
19
(b) the Minister is satisfied that the person approved has the
20
independence, and the knowledge or experience, necessary to
21
properly conduct the audit.
22
(4) An appointment of a person to conduct the audit made otherwise
23
than in accordance with subsection (2) has no effect.
24
(5) An approval under subsection (3) is not a legislative instrument.

460 Nature of directed environmental audit
26
(1) A person commits an offence if:
27
(a) the person is the auditor for a directed environmental audit;
28
and
29
(b) in the course of conducting the audit, the person does not
30
deal with a particular matter; and

(a) the person is the auditor for a directed environmental audit;

(b) in the course of conducting the audit, the person conceals, or
7
does not take into account, any information or document; and

(c) the information or document is relevant to the audit.

Penalty: Imprisonment for 6 months.

(3) The auditor for a directed environmental audit may have regard to
11
the results of a previous environmental audit, including such an
12
audit conducted in accordance with a condition or requirement of
13
an environmental authority or environmental order to which the
14
audit relates, if:
15
(a) the previous audit was completed within the last preceding 2
16
years; and
17
(b) the auditor is satisfied that the previous audit is still relevant.

461 Audit reports
19
(1) After completing a directed environmental audit, the auditor must
20
prepare, and give to the audited person, a written report that:
21
(a) sets out the results of the audit; and
22
(b) is in the form, and contains the particulars, specified for the
23
purposes of paragraph 458(4)(b).

Note:
A person may commit an offence if the person provides false or
25
misleading information or documents (see sections 137.1 and 137.2 of
26
the
Criminal Code
).
27
(2) The audited person must give the report to the Minister:
28
(a) on or before the day specified by the Minister under
29
paragraph 458(4)(c); or
30
(b) on or before such later day as the Minister, on application by
31
the audited person, determines in writing.

462D Conduct of audit

(1) The Minister need not give notice of a compliance audit.
26
(2) Before starting to conduct a compliance audit, the auditor for the
27
audit:
28
(a) must give a description of the scope of the audit to the
29
relevant person for the audit under subsection 462C(1); and
30
(b) must take reasonable steps to give such a description to any
31
relevant person for the audit under subsection 462C(2) whose
32
assistance the auditor considers will be reasonably necessary
33
for the conduct of the audit (see section 462E).

(1) A person must provide the auditor for a compliance audit with

assistance that is reasonably necessary for the conduct of the audit

if:

(a) the person is a relevant person for the audit under
21
subsection 462C(1); or
22
(b) the person is a relevant person for the audit under
23
subsection 462C(2) and the auditor requests the assistance of
24
the person.
25
(2) Without limiting subsection (1), providing assistance that is
26
reasonably necessary includes complying with any request under
27
subsection 462F(1) for the audit.
28
(3) Subsection (1) does not require a relevant person for the audit to
29
allow the auditor:
30
(a) to enter premises; or
31
(b) to take samples of any thing at premises; or
32
(c) to inspect any thing at premises.

(4) A person commits an offence if:

462G Register of auditors
17
(1) The Minister must cause a register of auditors to be kept for the

purposes of this Act.

(2) The Minister must register an individual in the register if:
20
(a) the individual has applied for registration in accordance with
21
regulations made for the purposes of subsection (4); and
22
(b) the Minister is satisfied that the individual meets such
23
requirements as to qualifications, knowledge, expertise,
24
competence, independence and other matters as are
25
prescribed by the regulations for the purposes of this
26
paragraph.

(3) If the Minister is not satisfied that an individual who has applied
28
for registration meets the requirements referred to in
29
paragraph (2)(b), the Minister must refuse to register the
30
individual.

(1) The Minister may issue an order under this section (an

(4) An environment protection order may be issued:

(a) by notice in writing; or

(b) if the Minister is satisfied it is necessary to do so because of

urgent circumstances

telephone).

(5) For the purposes of subsection (4), the notice may be:
25
(a) given to the person to whom the order applies, including, if
26
the notice is given orally and the person is not an individual,
27
by giving the notice to any employee or officer of the person
28
acting in that capacity; or
29
(b) given to any person who is acting as an agent of the person to
30
whom the order applies in relation to activities to which the
31
order relates.
32
(6) If the order is issued by notice in writing to an agent mentioned in
33
paragraph (5)(b), the Minister must, within 72 hours after the order
34
is issued, give a copy of the notice to the person to whom the order
35
applies.

giving brief details of any alleged contravention or potential

contravention to which the order relates; and
20
(d) set out the requirements imposed on the person by the order;
21
and
22
(e) either:
23
(i) specify when the order ceases to be in force; or
24
(ii) include a statement to the effect that the order will
25
remain in force until it is revoked by the Minister.

(2) If an environment protection order is issued by notice given orally
27
under paragraph 474A(4)(b):
28
(a) a requirement in subsection (1) of this section for the order to
29
contain a matter is taken to be a requirement for the Minister,
30
when issuing the order, to inform the person to whom notice
31
of the order is given of the matter; and

474C Duration of environment protection orders

(1) An environment protection order comes into force immediately

after notice of the order is given under subsection 474A(4).

(2) The order remains in force until the earlier of the following occurs:

no longer necessary for any of the purposes for which it was
