The Legislative Assembly of the Northern Territory enacts as follows:
This Act may be cited as the Anti-Discrimination Amendment Act 2014.
This Act amends the Anti-Discrimination Act.
(1) Section 4(1)
insert (in alphabetical order)
racially or religiously offensive conduct means conduct that is prohibited by section 22A.
(2) Section 4(1), definition prohibited conduct, after paragraph (b)
insert
(ba) racially or religiously offensive conduct; or
After section 22

22A Racially or religiously offensive conduct
(1) A person must not engage in a public act that is reasonably likely, in all the circumstances, to offend, insult, humiliate or intimidate another person or group of persons on the grounds of:
(a) the race of the person or any member of the group; or
(b) the religious belief or activity of the person or any member of the group.
(2) Despite section 28, subsection (1) applies to a public act in any area of activity (including, but not limited to, the areas mentioned in section 28).
(3) Subsection (1) does not apply if the person engages in the public act reasonably and in good faith:
(a) for academic, artistic, scientific or research purposes; or
(b) for making or disseminating:
(i) a fair and accurate report of an event or matter of public interest; or
(ii) a fair comment on an event or matter of public interest that is an expression of a genuine belief held by the person making the comment; or
(c) for a purpose that is in the public interest.
(4) If there is an inconsistency between this section and a provision of Part 4 or 5 that allows a person to engage in particular conduct, this section prevails.
(5) In this section:
public act includes the following:
(a) anything done in a public place;
(b) any form of communication to the public;
(c) any conduct observable by the public;
(d) the distribution of a thing to the public.
