2013 A Bill for An Act to amend the Aboriginal Land Act 1991, the Civil Liability Act 2003, the Environmental Protection Act 1994, the Forestry Act 1959, the Fossicking Act 1994, the Geothermal Energy Act 2010, the Greenhouse Gas Storage Act 2009, the Land Act 1994, the Land Protection (Pest and Stock Route Management) Act 2002, the Marine Parks Act 2004, the Mineral Resources Act 1989, the Nature Conservation Act 1992, the Petroleum Act 1923, the Petroleum and Gas (Production and Safety) Act 2004, the Recreation Areas Management Act 2006, the Survey and Mapping Infrastructure Act 2003, the Sustainable Planning Act 2009 and the Vegetation Management Act 1999 for particular purposes, and to make consequential or minor amendments to the Acts as stated in schedule 1 for purposes related to those particular purposes

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 2 Amendments commencing on assent [s 11] (b) any land that is, or is part of, a timber 1 reserve; or 2 (c) any land that is, or is part of, a forest reserve 3 under the Nature Conservation Act 1992. 4 Clause 11 Insertion of new s 25A 5 After section 25-- 6 insert-- 7 25A Particular forest reserve land set apart and 8 declared as State forest 9 (1) This section applies if forest reserve land is set 10 apart and declared as a State forest. 11 (2) The land ceases to be land in a forest reserve 12 under the Nature Conservation Act 1992. 13 (3) On the setting apart and declaring of the land as 14 State forest-- 15 (a) this Act applies to the land and its 16 management; and 17 (b) the Nature Conservation Act 1992, section 18 70G does not apply to the land. 19 (4) This section applies despite the Nature 20 Conservation Act 1992, section 70G(4). 21 (5) To remove any doubt, it is declared that the 22 setting apart and declaration of the land as a State 23 forest does not extinguish or affect native title or 24 native title rights and interests in relation to the 25 land. 26 (6) In this section-- 27 forest reserve land means land that-- 28 (a) is, or is part of, a forest reserve under the 29 Nature Conservation Act 1992; and 30 Page 17

 


 

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 2 Amendments commencing on assent [s 12] (b) is land to which the Nature Conservation 1 Act 1992, section 70G applies. 2 Clause 12 Amendment of s 28 (Power to set apart and declare 3 timber reserves) 4 Section 28(1), after `regulation'-- 5 insert-- 6 made before 30 June 2014 7 Clause 13 Omission of s 32AB (When setting apart and declaration, 8 revocation or amalgamation etc. takes effect) 9 Section 32AB-- 10 omit. 11 Clause 14 Replacement of s 96E (Protection from liability) 12 Section 96E-- 13 omit, insert-- 14 96E Protection from liability 15 (1) An official is not civilly liable for an act done, or 16 omission made, honestly and without negligence 17 under this Act. 18 (2) If subsection (1) prevents a civil liability 19 attaching to an official, the liability attaches 20 instead to the State. 21 (3) Also, the State or an official is not civilly liable in 22 a proceeding for an act done, or omission made, 23 in-- 24 (a) the performance or purported performance 25 of a function under this Act; or 26 (b) the exercise or purported exercise of a 27 power under this Act; or 28 Page 18

 


 

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 2 Amendments commencing on assent [s 14] (c) the management or operation of a State 1 forest or timber reserve. 2 Note-- 3 Land in a State forest could be a State plantation 4 forest under section 32A. 5 (4) However, subsection (3) does not apply to any 6 liability of the State or an official arising from the 7 State's or official's-- 8 (a) construction, installation or maintenance of 9 a State fixture, or State road, that is 10 defective other than because of a natural 11 event; or 12 (b) failure to give adequate notice of a State 13 fixture, or State road, that is defective other 14 than because of a natural event; or 15 (c) carrying out of a State management activity. 16 Examples of a natural event for paragraphs (a) and (b)-- 17 a storm, flood, period of heavy rain 18 (5) Also, subsection (3) does not apply in relation 19 to-- 20 (a) any liability of the State or an official for an 21 MAIA injury incurred by the State or 22 official as an insured person; or 23 (b) any liability of the State or an official for an 24 injury for which compensation is payable 25 under the Workers' Compensation and 26 Rehabilitation Act 2003 incurred by the 27 State or official in the State's or official's 28 capacity as an employer. 29 (6) For subsection (5)(b), the following is 30 immaterial-- 31 (a) whether compensation for the injury is 32 actually claimed under the Workers' 33 Compensation and Rehabilitation Act 2003; 34 Page 19

 


 

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 2 Amendments commencing on assent [s 14] (b) whether the entitlement to seek damages for 1 the injury is regulated under that Act. 2 (7) In this section-- 3 compensation see the Workers' Compensation 4 and Rehabilitation Act 2003, section 9. 5 damages includes any form of monetary 6 compensation. 7 defective includes damaged or destroyed. 8 insured person see the Motor Accident Insurance 9 Act 1994, section 4. 10 MAIA injury means a personal injury to which 11 the Motor Accident Insurance Act 1994 applies. 12 official means each of the following persons-- 13 (a) the Minister; 14 (b) the chief executive; 15 (c) a forest officer, plantation officer or other 16 officer appointed under section 17; 17 (d) a public service employee or another 18 employee of the State; 19 (e) a person acting under a delegation under 20 section 96B; 21 (f) an employee of a person mentioned in 22 paragraph (e); 23 (g) a person acting, on a voluntary basis 24 (irrespective of whether the person receives 25 out-of-pocket expenses), under the direction 26 of a person mentioned in paragraph (a), (b), 27 (c), (d), (e) or (f). 28 personal injury see the Civil Liability Act 2003, 29 schedule 2. 30 proceeding means a proceeding for damages 31 based on a liability for personal injury, damage to 32 Page 20

 


 

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 2 Amendments commencing on assent [s 14] property or economic loss resulting from 1 personal injury or damage to property, and, for a 2 fatal injury, includes a proceeding for the 3 deceased's dependants or estate. 4 State fixture means a building, structure or other 5 thing constructed or installed by the State 6 including, for example, the following-- 7 (a) a lookout or boardwalk; 8 (b) a stairway; 9 (c) a fence or other barrier; 10 (d) a thing used for a recreational purpose. 11 Examples for paragraph (d)-- 12 · a flying fox ride or zipline ride 13 · a rope or swing over a river or waterhole 14 · a ramp or jump on a mountain bike trail 15 · an anchor point for rock climbing 16 State management activity means-- 17 (a) programmed shooting or poisoning of 18 animals; or 19 (b) programmed burning or poisoning of 20 vegetation. 21 State road means-- 22 (a) a State-controlled road within the meaning 23 of the Transport Infrastructure Act 1994, 24 schedule 6; or 25 (b) another road, within the meaning of the 26 Transport Operations (Road Use 27 Management) Act 1995, constructed by the 28 State. 29 Page 21

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 2 Amendments commencing on assent [s 72] (a) prepare a new management plan for the 1 area; or 2 (b) amend the existing management plan for the 3 area; or 4 (c) leave the existing management plan for the 5 area unchanged; or 6 (d) if the Minister is satisfied it is appropriate in 7 the circumstances, decide that the existing 8 management plan be replaced with a 9 management statement for the area. 10 (3) If the Minister decides, under subsection (2)(d), 11 that the existing management plan be replaced 12 with a management statement for the area-- 13 (a) the Governor in Council may revoke the 14 approval of the existing management plan; 15 and 16 (b) if the approval is revoked--the chief 17 executive must prepare a management 18 statement for the area under this part to take 19 effect immediately after the revocation. 20 (4) Subsection (3)(b) does not apply if the area is 21 amalgamated with another area for which a 22 management statement is required under section 23 111, and either-- 24 (a) the regulation dedicating or declaring the 25 amalgamated area declares that an existing 26 management statement or existing 27 management plan applies to the 28 amalgamated area; or 29 (b) an existing management statement or 30 existing management plan is amended to 31 apply it to the amalgamated area. 32 (5) Also, if the area is a protected area, section 33 111(4) applies to the area as if section 111(4)(b) 34 also included a reference to a management 35 Page 58

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 3 Amendments about tenure commencing by proclamation [s 153] 202 Change in class does not affect instruments 1 applying to an area 2 (1) This section applies if, under this subdivision, an 3 area is changed from an old class of protected 4 area to another class of protected area (the new 5 class). 6 (2) Any of the following (each a relevant 7 instrument) in force for the area immediately 8 before the commencement continues to apply to 9 the area as a protected area of the new class-- 10 (a) a lease, agreement, licence, permit or other 11 authority; 12 (b) a management statement; 13 (c) a management plan; 14 (d) a direction, requirement, notice or decision 15 given or made, in writing, under this Act. 16 (3) The relevant instrument continues in force for the 17 area until it expires, is terminated or repealed or 18 otherwise ends under its terms or this Act. 19 (4) Subsections (2) and (3) apply even if the relevant 20 instrument authorises the carrying out of 21 activities in the area that are not consistent with 22 the management principles for protected areas of 23 the new class. 24 203 Particular previous use authorities continue 25 (1) This section applies to a previous use authority 26 taken to have been granted by the chief executive 27 under section 173R(2) as in force before the 28 commencement if the authority is still in force 29 immediately before the commencement. 30 (2) Section 173R(3) and (4) of the unamended Act 31 continue to apply to the previous use authority as 32 if the amendment Act had not been enacted. 33 Page 108

 


 

Nature Conservation and Other Legislation Amendment Bill (No. 2) 2013 Part 3 Amendments about tenure commencing by proclamation [s 153] 204 Deciding application for lease etc. for a 1 protected area of an old class 2 (1) This section applies to an application for a lease, 3 agreement, licence, permit or other authority (the 4 relevant authority) that-- 5 (a) was made, but not decided, under this Act 6 before the commencement; and 7 (b) is for a protected area of an old class that, 8 under this subdivision, is changed to a 9 protected area of another class (the new 10 class). 11 (2) The application is to be decided, as an 12 application for the relevant authority for a 13 protected area of the old class, under the 14 unamended Act, as if the amendment Act had not 15 been enacted. 16 (3) If the application is granted, the chief executive 17 must give or grant to the applicant the relevant 18 authority for the area as a protected area of the 19 new class. 20 (4) To remove any doubt, it is declared that 21 subsection (3) applies even if the carrying out of 22 the activities under the relevant authority is not 23 consistent with the management principles for 24 protected areas of the new class. 25 (5) However, the grounds on which the chief 26 executive may refuse an application to renew the 27 relevant authority include the ground that the 28 carrying out of the activities under the authority 29 is not consistent with the management principles 30 for protected areas of the new class. 31 Page 109
