Sugar Industry (Application of Transitional Provision) Amendment Bill 2017

Long Title

An Act to amend the Sugar Industry Act 1999 to extend the period within which particular supply contracts are not required to include particular terms

1 Short title

This Act may be cited as the Sugar Industry (Application of Transitional Provision) Amendment Act 2017.

2 Act amended

This Act amends the Sugar Industry Act 1999.

3 Insertion of new s 299

After section 298—

insert—

299 Continuing effect of particular existing cane supply contracts for a further period
(1) This section applies to an existing cane supply contract that has not ended contractually before the commencement.
(2) Section 33B starts applying to the existing cane supply contract on the earlier of the following—
(a) when the contract ends contractually;
(b) 1 July 2018.
(3) Until section 33B starts applying to the existing cane supply contract under subsection (2), the contract is taken to be a supply contract.
(4) This section applies to the existing cane supply contract even if, but for this section, section 33B would have started applying to the contract on 1 July 2017 under section 298(4).
(5) In this section—

"contractually", in relation to an existing cane supply contract ending, means ending because the event mentioned in section 298(3)(a) and, if applicable, the event mentioned in section 298(3)(b), has happened.

"existing cane supply contract" see section 298(1).
