LAND USE PLANNING AND APPROVALS AMENDMENT (WELLINGTON PARK MANAGEMENT TRUST VETO) BILL 2021 (Brought in by Cassandra Stanwell O'Connor MP) A BILL FOR An Act to amend the Land Use Planning and Approvals Act 1993 to restore the veto powers of the Wellington Park Management Trust in relation to developments in Wellington Park Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Land Use Planning and Approvals Amendment (Wellington Park Management Trust Veto) Act 2021. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Land Use Planning and Approvals Act 1993* is referred to as the Principal Act. *No. 70 of 1993 [Bill ] 3
Land Use Planning and Approvals Amendment (Wellington Park Management Trust Veto) Act 2021 Act No. of 2021 s. 4 4. Section 52A substituted Section 52A of the Principal Act is repealed and the following section is substituted: 52A. Permit for development of land in Wellington Park If any land in respect of which an application for a permit is required is in Wellington Park, as defined in the Wellington Park Act 1993 - (a) the application must - (i) be executed under the common seal of the Wellington Park Management Trust; or (ii) be accompanied by the written permission of the Trust to the making of the application; and (b) in assessing the application for the permit, the relevant planning authority must take into account the standards, values and conditions set out in each management plan, within the meaning of the Wellington Park Act 1993, in force as at the date of the application for the permit. 5. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which all of the provisions of this Act commence.
